The action to adopt or amend an NPDES permit is exempt from the provisions of Chapter 3 of the <br /> California Environmental Quality Act(CEQA) (Public Resources Code section 21000, et seq.), <br /> requiring preparation of an environmental impact report or negative declaration in accordance with <br /> Section 13389 of the California Water Code. <br /> 9. The Regional Board has notified the Discharger and interested agencies and persons of its intent to <br /> amend waste discharge requirements for this discharge and has provided them with an opportunity <br /> for a public hearing and an opportunity to submit their written views and recommendations. <br /> 10. The Regional Board, in a public meeting, heard and considered all comments pertaining to the <br /> discharge. <br /> 11. This Order shall amend WDR Order No. R5-2003-0065,NPDES No. CA0078093,pursuant to <br /> Section 402 of the CWA (33 U.S.C. section 1342), and amendments thereto, and shall take effect <br /> upon the date of hearing, provided EPA has no objections. <br /> IT IS HEREBY ORDERED that Waste Discharge Requirements Order No.R5-2003-0065 is amended <br /> solely to modify sampling requirements, and to correct a typographical error in Finding 39. The <br /> Department of Corrections, Deuel Vocational Institution, its agents, successors and assigns, in order to <br /> meet the provisions contained in Division 7 of the California Water Code and regulations adopted <br /> thereunder, and the provisions of the Clean Water Act and regulations and guidelines adopted <br /> thereunder, shall comply with the amended Waste Discharge Requirements Order No. R5-2003-0065: <br /> 1. Influent monitoring is amended as follows: reduce the sampling frequency from daily to weekly <br /> for influent pH and temperature; reduce the frequency from daily to twice weekly for BODS and <br /> total suspended solids; and delete nitrate from the list of constituents. A footnote is added stating <br /> that composite samples shall be flow proportioned. <br /> 2. Effluent monitoring from wastewater treatment plant Outfall 001 is amended as follows: reduce <br /> the sampling frequency from daily to twice weekly for BODS and total suspended solids; from <br /> daily to weekly for electrical conductivity and total coliform organisms; from weekly to monthly <br /> for total dissolved solids; from weekly to quarterly for acute toxicity; from monthly to quarterly for <br /> volatile organics; and from quarterly to annually for standard minerals. A footnote is added stating <br /> that composite samples shall be flow proportioned. <br /> 3. Effluent monitoring from industrial Outfalls 003 and 004 is amended as follows: reduce the <br /> sampling frequency from weekly to monthly for BODS,total coliform organisms, chlorine residual, <br /> electrical conductivity and total dissolved solids. <br />
