1 • <br /> Confidential Complaint: <br /> Generally, all complaints received are treated as confidential. A "confidential complaint" is any complaint <br /> currently under investigation, any complaint considered an investigative record, or any complaint pertaining to <br /> an enforcement proceeding, subject to rules governing confidential complaints contained in the Evidence Code <br /> section 1040 et seq. and/or Public Records Act sections 6254, subdivision(f) and (k). Although specified facts <br /> may be discloseable pursuant to a statutory directive, the analysis and recommendations of investigative <br /> personnel concerning such facts are exempt from disclosure under the Public Records Act. <br /> Confidential Complainant/Informant: <br /> A "confidential complainant" is someone who has designated themselves, or has been so designated by <br /> SCTS staff, on the SCTS complaint form, available at www.calepa.ca.gov. A confidential complainant's <br /> identifying information will be kept confidential, as permitted by Evidence Code sections 1040 and 1041 and/or <br /> the Public Records Act.
