EI Dorado Avenue, 3`d Floor <br /> Stockton, California 95202 <br /> Attn: Lorre Islas <br /> The California Department of Toxic Substances Control (DTSC) and City of Stockton <br /> Economic Development Department (Proponent) enter into this Amended Voluntary <br /> Cleanup Agreement (Agreement) for the purpose of reflecting changes in the scope of <br /> work and oversight cost estimate, and agree as follows: <br /> 1. Site. This Agreement applies to the property located at 411 South Stanislaus <br /> Street, in San Joaquin County, California 95203 (Site), identified by San Joaquin <br /> County Assessor's Parcel Number (APN) 149-261-09 through -17 and 149-262-01 <br /> through -19, and any off-site area to which hazardous substances have or may have <br /> migrated from the Site. The Site is approximately 3.5 acres in size and is bordered by <br /> E. Church Street on the south, S. American Street on the west, S. Stanislaus Street on <br /> the east, and adjacent vacant property to the north. Land use to the south is primarily <br /> residential, to the southwest is an elementary school and immediately to the west is a <br /> neighborhood park. A Site diagram and a Site location map are attached as Exhibits A <br /> and B. <br /> 2. Ownership. The Site is owned by Mercy Housing California XXXIX, a Limited <br /> Partnership. <br /> 3. Amended Scope of Work and DTSC Oversight. DTSC shall review and <br /> provide Proponent with written comments on all Proponent's deliverables as described <br /> in Exhibit C (Scope of Work) and other documents applicable to the scope of the <br /> project. Proponent agrees to perform all the work required by this Agreement. <br /> Proponent shall perform the work in accordance with applicable local, state and federal <br /> statutes, regulations, ordinances, rules and guidance documents, in particular, Health <br /> and Safety Code section 25300 et seq., as amended. <br /> 1 of 2 <br />
