California law requires a person to inform the state if a <br /> situation is encountered that can be considered an immediate endangerment to the <br /> public's health or welfare and/or to the environment. Therefore, the client shall be <br /> contractually bound to make said disclosures in lieu of Kleinfelder, its owners, <br /> principals, employees, or subcontractors. <br /> CLIENT RESPONSIBILITIES AND ASSUMPTIONS <br /> This Work Plan is based on the following assumptions: <br /> • This Work Plan is based on the presumption that Dameron personnel will <br /> clearly mark private utilities and will provide any and all available survey <br /> maps or other data to determine the location of underground storage <br /> tanks, existing subsurface structures, underground utilities and services. <br /> • Dameron will provide sufficient health and safety information from which <br /> Kleinfelder can develop an adequate health and safety plan for our field <br /> personnel. <br /> • This assessment does not include evaluation of leakage from the UST <br /> pipelines. If this work is desired, Kleinfelder can expand the scope of work <br /> for an additional fee. <br /> • Adequate workspace and access will be provided by the client. <br /> • A report will be provided for client review and comment. Any acceptable <br /> report changes will be made on a "time-and-materials" basis at an additional <br /> fee. <br /> • Two copies of the final report will be sent to the client. <br /> • Kleinfelder is not responsible for the site safety of others. <br /> • Soil and/or water generated during the field assessment will be the <br /> responsibility of the client.
