(e)The owner or operator shall maintain training records on current personnel until closure of the facility and training records on former employees for at least three years from the date the employee last worked at the facility. Personnel training records may accompany personnel transferred within the same company. CORRECTIVE ACTION: Immediately train all employees who work with hazardous waste in compliance with the time frames and training materials required by this section. Provide training documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. The documentation must include a list of training topics, date of training,job title, name of employee,written job description (qualifications and duties), and employee signed (or certified)record that documents the training. This is a Class II violation. 118 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three years from 12-9-2016 to 12-9-2019 during the inspection. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Provide a copy of disposal records for the past three years from 12-9-2016 to 12-9-2019 for all hazardous waste including used oil, used oil filters, and waste antifreeze. Provide these records and a corrective action statement to the EHD within 30 days. This is a Class II violation. 124 HSC 25404(e)(4) Failed to report program data in the California Environmental Reporting System (CERS). OBSERVATION: This business's hazardous waste activities have not been reported on the California Electronic Reporting System (CERS)website. HMBP inspector helped operator create a CERS account and make CERS submittal while on site. REGULATION GUIDANCE: Each regulated business shall report program data electronically on the CERS website.
