The enclosed table is our <br /> preliminary ARAR identification. Each of the potential ARARs identified in <br /> the table have aspects that are chemical-, action- and location-specific. <br /> Future iterations of ARAR identification will clarify the specific <br /> applications. In order to assist DDRW, Tracy in meeting Regional Board ARARs, <br /> we have also enclosed our 17 May 1991 memorandum which provides generic <br /> discussions on potential ARARs. We understand that ARARs for aquifer cleanup <br /> will not be finalized until the final site-wide Record of Decision (ROD) . <br /> The Porter-Cologne Water Quality Control Act reflects that it is the intent of <br /> the California Legislature that the State Water Board and each Regional Board <br /> shall be the principal state agencies with primary responsibility for control <br /> of water quality. Standards are established in the Water Quality Control <br /> Plans adopted by the State Board and each Regional Board. The beneficial use <br /> designations and water quality objectives, contained therein, apply to any <br /> waste discharge which may pose a threat to water quality. In order to select <br /> a water quality goal , water quality standards from the applicable Water <br /> Quality Control Plans are used with information specific to the site and the <br /> wastes which have been discharged to determine the water quality goals for <br /> each waste constituent so as to protect the beneficial uses of the waters of <br /> the State. Enclosed is a flow diagram which depicts the decision pathway used <br /> to select a water quality goal . <br /> The Water Quality Control Plan for the San Joaquin Basin (5C) (Basin Plan) has <br /> designated all ground water, with only a few exceptions (as defined in the <br /> State Water Resources Control Board Resolution No. 88-63) , to have existing or <br /> potential beneficial uses as sources of drinking water. In order to protect <br /> the beneficial uses of the ground water, all Primary and Secondary MCLS must <br /> be met, at a minimum, for the aquifer cleanup level and the MCL Goal must be <br /> considered per Section 121(2) (A) of the Comprehensive Environmental Response, <br /> Compensation and Liability Act (CERCLA) statute. In addition, Article 5 of <br />
