Shell (now Equilon) operated the retail petroleum fueling station until <br /> January 1999 when the underground storage tanks (USTs) were removed and replaced. The site is <br /> currently leased to an independent retailer selling Shell-branded products. Ms. Karen Petryna, c/o Equiva <br /> Services LLC is the representative for Equilon. <br /> Following UST removal in January 1999, soil and groundwater contamination was identified near the <br /> former fuel dispensers, and monitoring well (MW-5) was installed in February 2000. (Monitoring wells <br /> MW-1 through MW-4 were destroyed following a previous site closure.) Methyl tertiary butyl ether <br /> (MtBE)was identified in MW-5 at 10.3 micrograms per liter (µg/1) on 9 March 2000, and at 32.4 µg/1 on <br /> 5 June 2000 by EPA Method 8260B. <br /> The City of Lodi Municipal Well No.12 (Well 12), an active well used daily, is approximately 150 feet <br /> southwest of MW-5. Our priority is to protect Well 12 from MtBE impacts resulting from the release at <br /> your site. Therefore, you must take immediate steps to identify the extent of your groundwater <br /> contamination. <br /> The required "Technical Report" is a report as described in Section 13267 of the California Water Code, <br /> which states, in part: <br /> "(b)(1)In conducting an investigation ..., the regional board may require any person who has discharged, <br /> discharges, or is suspected of discharging, or who proposes to discharge waste within its region...shall furnish, under <br /> penalty of perjury, technical or monitoring reports which the regional board requires. The burden, including costs, of <br /> these reports shall bear a reasonable relationship to the need for the report and the benefits to be obtained from the <br /> reports." <br /> In accordance with Section 13267 of the California Water Code, you are required to submit the <br /> Technical Report to this office by 12 February 2001.
