C. LIMITATIONS <br /> The Limited Phase II findings are based on the conditions existing at the site on March 19 <br /> through March 23, 2012, when the field sampling was conducted. This work was performed in <br /> accordance with the January 23, 2012, proposal that was approved by the Client and the site <br /> owner. This Assessment has been conducted and prepared in accordance with generally <br /> accepted practices and procedures exercised by reputable professionals under similar <br /> circumstances. PEI makes no other warranties or guarantees, either expressed or implied, as <br /> to the findings, opinions, or recommendations contained in this report. <br /> Physical limitations to the field work included the following: <br /> ♦ The chemical mixing room had three roll-up doors that have been replaced by framing and <br /> plywood. One of these "walls" had to be taken down temporarily to access the room with <br /> drilling equipment. <br /> ♦ Other rooms in the main building were inaccessible to the drilling equipment. <br /> ♦ Due to significant alterations to the property's surface and structures over time (e.g., site <br /> re-paving, pavement patching, installation and removal of interior and exterior equipment <br /> and subsurface items, etc.), visual observations and geophysical survey results may have <br /> been affected such that potential areas or items of concern may not be readily recognizable <br /> or included in the work performed. <br /> This Limited Phase II was not fully comprehensive in nature but was restricted to areas <br /> discussed herein. The findings presented in this report were based on the subsurface <br /> conditions encountered in the areas investigated during the time frame of this assessment. <br /> These findings may not be considered representative of future conditions in the areas <br /> investigated or conditions in any untested areas of the site. This investigation was performed <br /> in accordance with generally accepted practices of the profession undertaking currently similar <br /> studies in the same geographical area. No other warranty is expressed or implied. <br /> It should be recognized that this study was not intended to be a definitive investigation of <br /> potential impact at the subject property. Given that the Scope of Services for this investigation <br /> was limited and that the investigation was further limited by the lack of accessibility in some <br /> areas, it is possible that currently unrecognized impacts (or higher levels than those found) may <br /> exist at the site. Therefore, PEI cannot act as insurers and cannot "certify" that a site is free <br /> from environmental contamination, that impact does not exist below a certain level in other <br /> areas of the site, or that some other, currently unrecognized, environmental impact does not <br /> exist at the site. <br /> The recommendations provided in this report do not constitute legal advice and should not be <br /> relied upon in any way for legal interpretations. This report has been prepared for the sole use <br /> of the Client, affiliates, and assigns of the Client.
