Failed to keep signed designated facility copy of the Uniform Hazardous Waste Manifest. Missing <br /> signed designated facility copy with tracking number: 000539135FLE (shipped 05/12/2008) and <br /> 000536548FLE (shipped 10/14/2008). A generator shall keep a copy of each manifest signed for three <br /> years or until the generator receives a signed copy from the designated facility which received the <br /> waste. The signed copy received from the designated facility for at least 3 years from the date the waste <br /> was accepted by the initial transporter. Correct by submitting a copy of the two mentioned manifest with <br /> the signature of the designated facility confirming the waste was received. <br /> # 61. Failed to determine the status of the HW if no (Treatment Storage Disposal Facility) TSDF copy is <br /> received. It is undetermined if the two above hazardous waste arrived to its TSDF site. A generator who <br /> does not receive a copy of the handwritten signature of the owner or operator of the designated facility <br /> within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter <br /> and/or owner/ operator of the designated facility to determine the status of the hazardous waste. <br /> # 62. Failed to file an exception report. A generator shall submit an Exception Report to Department of <br /> Toxic Substance Control if the generator has not received a copy of the manifest with the handwritten <br /> signature of the owner/ operator of the designated facility within 45 days of the date the waste was <br /> accepted by the initial transporter. Exception Report includes: legible copy of the manifest for which the <br /> generator does not have confirmation of delivery and a cover letter signed by the generator/ generator's <br /> authorized representative explaining the efforts taken to locate the HW and the results of those efforts. <br /> # 64. Failed to retain copy of manifest/ bill of lading/ disposal receipt for spent lead acid batteries. No <br /> disposal receipts for lead acid batteries were available for review. Four spent lead acid batteries were <br /> stored on a cart for an undetermined amount of time. A generator shall retain on-site for a minimum of 3 <br /> years copies of manifest/ bill of lading/ disposal receipt which identifies spent lead acid storage batteries <br /> shipped to a person who recycles or reclaims the batteries for their components. Correct by properly <br /> disposing the spent lead acid batteries to a certified hazardous waste collection center for spent lead <br /> acid batteries and keep the disposal receipt on-site at the generator's facility for a minimum of 3 years. <br /> Submit a copy of the disposal receipt to SJC EHD within 30 days (09-06-10). <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($115). <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY ATE. <br /> EHD Inspector: By: <br /> T TRAN Titl <br /> 1-7 <br />
