Failed to store Universal Waste fluorescent lamps in a closed container and in a manner that <br /> prevents breakage and release into the environment. There are several long fluorescent tubes in a <br /> corner located by the roll up door and some waste 3' fluorescent tubes in an open cardboard box. A <br /> universal waste handler shall contain any lamp in a container or package that is structurally sound, <br /> adequate to prevent breakage, and compatible with the contents of the lamp. Such container/ package <br /> shall remain closed and shall lack evidence of leakage, spillage or damage that could cause leakage <br /> under reasonably foreseeable conditions. Correct immediately by containing the waste fluorescent <br /> lamps in a secure structurally sound container. <br /> # 83. Failed to label universal waste to identify the type of universal waste. There are several long <br /> fluorescent tubes in a corner located by the roll up door and some waste 3' fluorescent tubes mixed with <br /> new 3' fluorescent tubes. It is unknown which tubes are clearly identified as unusable. Lamps, those <br /> which are clearly are waste lamps, should be in a container/ package that shall be labeled/ marked <br /> clearly with the following phrase: "Universal waste-Lamp(s)". Correct immediately by placing the <br /> fluorescent tubes in a clearly marked package with the identifying phrase. <br /> # 84. Storage of universal fluorescent tubes for unknown period of time when it became a waste. A <br /> universal waste handler shall accumulate universal waste for no longer than 1 year from the date the <br /> waste was generated. Universal waste shall be marked with a label with the date it became a waste or <br /> maintain inventory system on-site that identifies when it became a waste or any other method which <br /> clearly demonstrates length of time. Correct immediately by having the fluorescent tubes be properly <br /> disposed of at a certified hazardous waste facility and keep the disposal receipt on-site at the <br /> generator's facility for a minimum of 3 years. Submit a copy of the disposal receipt to SJC EHD within 30 <br /> days (09-06-10). <br /> Submit to SJC EHD within 30 days (09-06-10): <br /> 1 . one copy of the "Return to Compliance Certification" form <br /> 2. a corrective action statement for the above violations <br /> 3. requested/ supporting documentations <br /> Notes: <br /> • # 20. One 55 gallon blue plastic drum not identified as waste acetone in the material supply shed located <br /> in parking lot. Corrected on-site. Labeled with words "Hazardous Waste", generator's name & address, <br /> contents (waste acetone), physical state (liquid), hazardous property (toxic), initial start accumulation date. <br /> • Provided Small Business HW Brochure, blank HW labels <br /> • Facility is powder coating (low VOCs) business. Powder coat baked onto metal pieces at +400°F. <br /> Operations hours: spring/ summer/ fall typically 4:30AM-1:30PM. Winter hours shifts later. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($115). <br /> THIS FACILITY IS SUBJECT TO REINSPECTION ATA�q TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector HUY TRAN e ed B T' <br />
