Robert McClellon,R.E.H.S. <br /> Program Manager Fax: (20 } 464-0138 Mark Barcellos,R.E.H.S. <br /> ERNEST J POMBO JR NOV 18 2002 <br /> 1755 W 11" STREET <br /> I <br /> TRACY CA 95376 <br /> RE: Pombo Ranch Property SITE CODE: 508110 <br /> 24100 Lammers Road <br /> Tracy CA 95376 <br /> On November 13, 2002 a meeting was held at the office of the San Joaquin County <br /> Environmental Health Department (SJCIEHD)to discuss the above referenced site. <br /> Present at the meeting were Mr. Dave Butz, representing Bright Development; Mr. Marty <br /> Hartzell from the Central Valley Regional Water Quality Control Board; and Ms. Margaret <br /> Lagorio, Mr. Nuel Henderson and Ms. Lori Duncan from SJCIEHD. The meeting was <br /> called to discuss your failure to comply with regulatory directives to submit a work plan to <br /> continue the investigation and remediation of the petroleum hydrocarbon contamination <br /> that has been documented at your site. <br /> Several issues were discussed at the meeting: <br /> i <br /> i <br /> 1. The responsible party to this site is the listed owner of the property, which <br /> remains Ernest J. Pombo EST. It is not Bright Development. Should Bright <br /> Development proceed with purchase o the property they would be named as <br /> an additional responsible party to the site, but as the owner of the property at <br /> the time of the tank removals, Ernest J Pombo EST will remain as a listed <br /> responsible party. <br /> 2. SJCIEHD had directed that a work plan be submitted by March 5, 2001. The <br /> work plan was to complete the site investigation and to implement the ! <br /> conditionally approved Corrective Action Plan dated March 31, 2000. Having <br /> failed to submit the requested work plan, the site is currently out of <br /> compliance with regulatory directives. Possible enforcement actions were <br /> discussed, as well as the fact that the enforcement would be directed to the <br /> responsible party, Ernest J. Pomba EST. i <br /> 3. Alternative methods for performing the proposed corrective action, over- <br /> excavation of source area soil contami ation, were discussed. SJCIEHD <br /> suggested that uncontaminated overb irden soil could be stockpiled <br /> separately from the contaminated soil , and following completion of the <br /> excavation could be used as backfill. n addition, if there is sufficient room at <br /> the site, the contaminated soil could b treated on site by aeration. These <br /> two changes to the proposal of transporting all of the excavated soil to a i <br /> landfill could substantially reduce the dost of the remediation. Mr. Butz was <br /> encouraged to seek bids from different consultants for implementation of the <br /> work plan. <br />
