Ami Adini &Associates, Inc. June 15, 2010
Mr. Larry Witwer Page 2
soil borings B1, B2, and B3 directly in the middle of our traffic lanes. I note that at the
Texaco service station to our west, you have accommodated soil borings by locating
them in planter areas and outside the driveway activities. Consequently, we are going
to ask that you modify your soil borings to accommodate our traffic patterns and without
mitigating the water contamination data, we feel that it would be appropriate to relocate
soil boring 131 a few feet to the west in the landscape area, locating soil boring B2 to the
center landscape area or even one of the parking areas and locating soil boring B3
either closer to the building or once again, in the center aisle where the parking and
landscaping is located. Those relocations would accommodate our traffic patterns and
not meaningfully affect your sampling. As indicated in the EHD letter, monitoring well
#28 can be located after the results of the soil borings. Consequently, albeit tentative,
the middle of our drive area is truly unacceptable and will interfere with our normal
business operation. We suggest that you consider, if at all, locating MW#28 twenty
(20) feet east into the center planter area without any degradation of your water
sampling activities. By copy of this letter, we are making this suggestion to EHD as
well.
Thank you for your cooperation in this matter. We look forward to completing our
agreements as soon as possible.
Should you have any questions, do not hesitate to contact me.
Very trul i rs,
DE IS C. NOBLE
Attorney at Law
Cc: A. Coltrin
SJC Environmental Health Department
DCN\ColMnWmi Adini-61510
