We observed <br /> evidence of a leaking dispenser at your diesel tank and observed soil stains in the vicinity of the truck <br /> wash area and the gasoline tank building. We were told that the underground piping associated with the <br /> gasoline tank had leaked, and that a limited subsurface investigation had been performed. Some <br /> contaminated soil had been removed, water in the nearby irrigation ditch sampled, and soil and <br /> groundwater sampled. Analytical results of this work detected up to 16,000 µg/l of total petroleum <br /> hydrocarbons (tph) as gasoline, 4900 gg/L MtBE, and 690gg/L benzene, as well as toluene, <br /> ethylbenzene, and toluene in groundwater samples taken in July 1998 in the vicinity of the gasoline tank. <br /> Soil from the same area had detections of 10,000 mg/kg tph-diesel, 7800 mg/kg tph-motor oil as well as <br /> tph-gasoline, benzene and MtBE. Water in the irrigation ditch sampled on 8 July 1998 had detections <br /> up to 6800 gg/L tph-diesel and 62,000gg/L tph-motor oil. <br /> Staff requested submittal of a work plan for further investigation, source remediation and assessment of <br /> site groundwater. The work plan has been submitted and approved. We appreciate your response in this <br /> matter. <br /> At the time of staffs visit, we understood that your facility had not filed a Storage Statement or paid <br /> fees for the active aboveground tanks. This is required under the Aboveground Petroleum Storage Act <br /> for any facility storing 660 gallons of petroleum in any one tank, or more than 1320 gallons <br /> cumulatively in more than one tank. The enclosed brochure, Information on the Aboveground <br /> Petroleum Storage Tank Program, gives further explanation and will help you to calculate your fees. <br /> You are required to file a storage statement and pay fees for petroleum storage on a two-year cycle. If <br /> you have not filed previous storage statements,you probably will need to pay fees in arrears. <br /> The Aboveground Petroleum Storage Act(APSA) requires tank facilities to reimburse the Regional <br /> Board for reasonable expenses to oversee cleanup and abatement of leaks or spills at storage facilities. <br /> Reimbursement moneys for oversight are deposited in the Environmental Protection Trust Fund(EPTF), <br /> which was created by the APSA. On 5 August 1999, in a telephone conference, Gail Wiggett of my <br /> staff discussed with you, your consultant, Mr. Little, and your attorney , Ms. Zolezzi, the cost recovery <br /> procedure and your reimbursement obligations under the APSA.
