<br /> IF 17 SURVEY / SITE ASSESSMENT . During the term of this Agreement , Shell ,
<br /> its agents or contractors , shall have the right to enter upon the Premises for
<br /> the purpose of conducting a topographical survey and a site assessment of the
<br /> Premises , The site assessment may include , but not be limited to , subsurface
<br /> soil and water tests , as well as the testing of any underground storage tanks
<br /> and related equipment upon the Premises . Shell shall assume all risks involved
<br /> in er } tering upon the Premises for the performance of such activities and shall
<br /> indemnify and hold Seller harmless from and against all loss or expense by
<br /> IF I reason of any liability due to bodily injury , death of persons or damage to
<br /> property sustained by any party arising out of or caused by the negligence of
<br /> Shell , its agents or contractors in the exercise of any of Shell ' s rights under
<br /> this article . Shell , its agents or contractors , shall also have the right to
<br /> make inquiries to or contact with governmental agencies concerning potentially
<br /> hazardous substances on the Premises without any liability on the part of
<br /> Shell , its agents or contractors , to Seller as a result thereof .
<br /> If , in Shell ' s sole opinion , the governmental inquiry or contact , or the site
<br /> assessment reveals conditions which are unsatisfactory to Shell , Shell may
