Report of Findings—Dairy Waste Removal Page 2 <br /> Teixeira—Souza Dairy November 27,2006 <br /> WKA No.6504.07 <br /> REGULATORY AGENCY POLICY <br /> Throughout the waste removal process,representatives from the California Regional Water <br /> Quality Control Board(RWQCB)and the San Joaquin County Environmental Health <br /> Department(EHD)were consulted to determine the applicable requirements for closure. Neither <br /> regulatory agency has regulations or permitting requirements for the closure of dairies that do not <br /> currently operate under Waste Discharge Requirements. The current RWQCB and San Joaquin <br /> County EHD policy on closure of dairies similar to the Teixeira-Souza Dairy consist of removing <br /> all visible waste, evaluating any potential impacts to the environment,and providing disclosure <br /> to future land owners that the groundwater may be impacted. <br /> Initially, representatives from the RWQCB and the San Joaquin County EHD requested notice <br /> when waste removal activities were completed in order to have the opportunity to inspect site <br /> conditions prior to backfilling with clean fill. However, when the representatives were updated <br /> on the due diligence measures being implemented during closure,they felt the Site was being <br /> properly managed and that an inspection would not be necessary. <br /> The RWQCB has already received a closure letter from Mr. Isidoro Teixeira stating that the <br /> dairy will no longer be a confined animal facility and that the property has been sold for <br /> development. The San Joaquin County EHD has already removed the dairy from the active dairy <br /> list. Both the RWQCB and the San Joaquin County EHD have indicated that no further <br /> notification is required but a copy of this Report of Findings would be useful for their files. <br /> FIELD ACTIVITIES <br /> Qualified representatives from WKA, including geologists and trained earthwork technicians, <br /> oversaw the waste removal process conducted by ALP. The waste removal process consisted of <br /> the following distinct phases of field activities: <br /> • Visual�� re�a Observation of Waste Removal <br /> Was <br /> • Visual Confirmation of Waste Removal <br /> • Soil Gas, Soil, and Groundwater Investigation <br /> Each of these activities is detailed in the following pages. <br />
