Monier Lifetile - 2 - 7 April 2005 • The Storm Water Permit requires implementation of Best Management Practices (BMPs) to reduce or prevent pollutants associated with industrial activities in storm water discharges. Based on the review of available information it appears that Monier Lifetile failed to fully implement BMPs to eliminate potential pollutant (non-storm water) discharges. You must modify your existing BMPs or implement new BMPs to reduce or eliminate the discharge of pollutants. • A complete Storm Water Pollution Prevention Plan (SWPPP) and Monitoring Program are required to be on-site and available to operating personnel and inspectors. You must modify your SWPPP as well as your Monitoring Plan to address these violations. Failure to have a complete SWPPP and a Monitoring Program on-site is a violation of the terms and conditions of the Storm Water Permit. We request that you submit updated copy of your SWPPP and Monitoring Program to this office by 13 May 2005. All of the above referenced items are violations of the Storm Water Permit. Under Section 13385 of the California Water Code, the Regional Board can impose administrative civil liabilities for violations of the Storm Water Permit. The maximum fine for each violation is ten thousand dollars ($10,000)per day. We request that Monier Lifetile submit by 13 May 2005 an updated SWPPP and Monitoring Plan to address above violations. This information will assist Regional Board staff in assessing compliance with the Storm Water Permit.
