CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD CENTRAL VALLEY REGION ORDER NO. T WASTE DISCHARGE REQUIREMENTS FOR J. R. SIMPLOT COMPANY STORMWATER SURFACE IMPOUNDMENT AND CLASS II SURFACE EAPOUNDMENTS SALT JOAQUIN COUNTY The California Regional Water Quality_ Control Board, Central Valley Region, (hereafter Board), N finds that: 1. J. R. Simplot Company (hereafter Discharger) submitted a Report of Waste Discharge dated 12 November 1993 for existing surface impoundments at its Lathrop facility. Additional information concerning the waste management units (WMUs) was submitted in December 1993 and on 2 May 1994. 2. The Report of Waste Discharge requests revised waste discharge requirements (WDRs) for construction and reclassification of three surface impoundments to Class II surface impoundment waste management units (WMUs) and one stormwater surface impoundment. 3. The WMUs are currently regulated by Waste Discharge Requirements Order No. 83-038 which is no longer in conformance with Title 23, California Code of Regulations (CCR), Division 3, Chapter 15 (hereafter Chapter 15). U�1 4. The Discharger's existing monitoring program for ground water, surface water, and the unsaturated zone for these WMUs do not satisfy the requirements outlined in Article 5 of Chapter 15 as amended July 1, 1991. 5. The 341 - acre facility. comprised of Assessor's Parcel Numbers: Bk 198. Pg 140. Par 03, 04, 05, 10, & 11; Pg 150, Par 0l through 05: Pg 160, Par 09; and PR 180, Par 01 through 09 was previously owned by Occidental Chemical Company. As of 1 January 1983, Occidental Chemical Company conveyed to the Discharger, certain property and assets of the Lathrop facility. The Lathrop facility is one mile south of the town of Lathrop in Section 35, Township 1S, R6E, MDB&M as shown in Attachment A , which is incorporated herein and made part of this Order. The Discharger presently owns all the land comprising the Lathrop facility, and all the improvements to the land except the ground water remedial system (treatment plant, associated monitoring wells and extraction and injection wells) its supporting laboratory, records and equipment. 6. Under terms and conditions of the Stipulation and Judgment Approving Settlement (No. CIV S-79-898 MLS) for investigation and cleanup of the Occidental Chemical Company site. approved by the U. S. District Court 9 February 1981 Occidental Chemical Company is responsible for investigation and remediation of the site. 7. Under terms of the Stipulation and Order (hereafter Stipulation) approved by the Court 21 December 1982. California consented to the transfer from Occidental Chemical Company to Simplot of the Lathrop property and assets provided that Occidental Chemical Company expressly retains full responsibility for compliance with all obligations imposed by the
