CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD <br /> CENTRAL VALLEY REGION <br /> ORDER NO. T <br /> WASTE DISCHARGE REQUIREMENTS <br /> FOR <br /> J. R. SIMPLOT COMPANY <br /> STORMWATER SURFACE IMPOUNDMENT <br /> AND <br /> CLASS II SURFACE EAPOUNDMENTS <br /> SALT JOAQUIN COUNTY <br /> The California Regional Water Quality_ Control Board, Central Valley Region, (hereafter Board), N <br /> finds that: <br /> 1. J. R. Simplot Company (hereafter Discharger) submitted a Report of Waste Discharge dated <br /> 12 November 1993 for existing surface impoundments at its Lathrop facility. Additional <br /> information concerning the waste management units (WMUs) was submitted in December <br /> 1993 and on 2 May 1994. <br /> 2. The Report of Waste Discharge requests revised waste discharge requirements (WDRs) for <br /> construction and reclassification of three surface impoundments to Class II surface <br /> impoundment waste management units (WMUs) and one stormwater surface impoundment. <br /> 3. The WMUs are currently regulated by Waste Discharge Requirements Order No. 83-038 <br /> which is no longer in conformance with Title 23, California Code of Regulations (CCR), <br /> Division 3, Chapter 15 (hereafter Chapter 15). U�1 <br /> 4. The Discharger's existing monitoring program for ground water, surface water, and the <br /> unsaturated zone for these WMUs do not satisfy the requirements outlined in Article 5 of <br /> Chapter 15 as amended July 1, 1991. <br /> 5. The 341 - acre facility. comprised of Assessor's Parcel Numbers: Bk 198. Pg 140. Par 03, <br /> 04, 05, 10, & 11; Pg 150, Par 0l through 05: Pg 160, Par 09; and PR 180, Par 01 through <br /> 09 was previously owned by Occidental Chemical Company. As of 1 January 1983, <br /> Occidental Chemical Company conveyed to the Discharger, certain property and assets of the <br /> Lathrop facility. The Lathrop facility is one mile south of the town of Lathrop in Section 35, <br /> Township 1S, R6E, MDB&M as shown in Attachment A , which is incorporated herein and <br /> made part of this Order. The Discharger presently owns all the land comprising the Lathrop <br /> facility, and all the improvements to the land except the ground water remedial system <br /> (treatment plant, associated monitoring wells and extraction and injection wells) its <br /> supporting laboratory, records and equipment. <br /> 6. Under terms and conditions of the Stipulation and Judgment Approving Settlement (No. CIV <br /> S-79-898 MLS) for investigation and cleanup of the Occidental Chemical Company site. <br /> approved by the U. S. District Court 9 February 1981 Occidental Chemical Company is <br /> responsible for investigation and remediation of the site. <br /> 7. Under terms of the Stipulation and Order (hereafter Stipulation) approved by the Court 21 <br /> December 1982. California consented to the transfer from Occidental Chemical Company to <br /> Simplot of the Lathrop property and assets provided that Occidental Chemical Company <br /> expressly retains full responsibility for compliance with all obligations imposed by the <br />
