16. Class 16- AmerUS Life Secured Claim(GWI) a. Claim in Class: Class 16 consists of the AmerUS Life Secured Claim against GWI,which Claim is secured by a Lien against the AmerUS Life Escrow and the GIX'I Warehouse and all proceeds thereof. b. Treatment. It is anticipated that the AmerUs Life Secured Claim will be paid in full prior to the Effective Date from the distribution of the AmerUs Life Escrow and the GWI Warehouse Proceeds. If such distribution has not occurred prior to the Effective Date,then as soon as practicable after the Effective Date Reorganized GWI or the Disbursing Agent will distribute to AmerUS Life. in full and final satisfaction of the AmerUS Life Secured Claim,the AmerUS Life Escrow and the GWI Warehouse Proceeds. Any GWI Warehouse Proceeds thereafter remaining shall be distributed to holders of Allowed Class 17 Claims. 17. Class ;:'- General Unsecured Claims(GWI) a. Claims in Class: Class 17 consists of all General Unsecured Claims against GWI. b. Treatment: After the Class 16 Claim has been paid in full,each holder of an Allowed Class 17 Claim shall receive,on the Distribution Date,its pro rata share of any then remaining GWI Warehouse Proceeds until all Allowed Class 17 Claims have been paid in full. Any GWI Warehouse Proceeds thereafter remaining shall be distributed under the Plan as Net Cash Proceeds. 18. Class 18-Interests(GWI) a. Interests in Class: Class 18 consists of all Interests in GWI. b. Treatment: The holder of the Class 18 Interests will retain those Interests under the Plan. D. Allowed Claims Notwithstanding any provision herein to the contrary,the Disbursing Agent shall only make distributions to holders of Allowed Claims. No holder of a Disputed Claim will receive any distribution on account thereof until and to the extent that its Disputed Claim becomes an Allowed Claim. At the request of any Debtor,the Disbursing Agent shall withhold distributions otherwise due hereunder to the holder of a Claim until the Claims Objection Deadline,to enable the Debtors to file a timely objection thereto. The Disbursing Agent will establish a reserve for Disputed Claims in accordance with Article VI Section B hereof. The presence of a Disputed Claim in any Class will not be a cause to delay distribution to Allowed Claims in that Class or in junior Classes,so long as a reserve is created for the Disputed Claim in accordance herewith. Any holder of a Disputed Claim that becomes an Allowed Claim after the Distribution Date will receive its distribution, without Postpetition Interest(except as otherwise expressly provided in the Plan),on the next Periodic Distribution Date. E. Full Satisfaction The Disbursing Agent shall make,and each holder of a Claim shall receive,the distributions provided for in the foregoing provisions of this Article III in full satisfaction and discharge of all Claims against the Debtors. F. Post-petition Interest In accordance with section 502(b)(2)of the Bankruptcy Code, the amount of all Claims against the Debtors shall be calculated as of the Petition Date. Except as otherwise explicitly provided herein(particularly for holders of Claims in Subclasses 5A and 5B),no holder of a Claim shall be entitled to or receive Postpetition Interest. G. Alternative Treatment Notwithstanding any provision herein to the contrary,any holder of an Allowed Claim may receive,instead of the distribution or treatment to which it is entitled hereunder,any other distribution or treatment to which it and the Debtor obligated on its Claim may agree in writing.
