CLEANUP AND ABATEMENT ORDER NO. 94-704 -3- <br /> LEPRINO FOODS COMPANY <br /> TRACY TRACY FACILITY <br /> SAN JOAQUIN COUNTY <br /> IT IS HEREBY ORDERED that pursuant to Section 13304 and 13267 of the California <br /> Water Code, Leprino Foods Company shall: <br /> 1. Cleanup and abate, forthwith, the effects of petroleum products discharged to soils <br /> and ground water at its Tracy facility. "Forthwith" means as soon as is reasonably <br /> possible. <br /> 2. Reports and work plans are to follow the soil and ground water investigation process <br /> described in the Tri-Regional Recommendations and its Appendix A which are made a <br /> part of this Order. Compliance with 1 above shall include, but not be limited to, the <br /> following measures: <br /> a. By 30 July 1994 submit a work plan and time schedule to delineate the lateral <br /> and vertical extent of soil and ground water contamination at the facility. <br /> b. Upon approval of the work plan required in (a), implement the work plan in <br /> accordance with the approved time schedule which will become part of this <br /> Order. <br /> C. By the 30th of the month following the end of each calendar quarter, submit <br /> quarterly reports which provide information on the investigations, remediation <br /> systems operation, remediation activities, and results of ground water sampled <br /> and analyzed for total petroleum hydrocarbons, benzene, toluene, <br /> ethylbenzene, and xylene as specified in Monitoring and Reporting Program <br /> No. 93-811. <br /> d. By 1 December 1994 submit a Problem Assessment Report. <br /> e. By 1 June 1995 submit for approval a Final Remediation Plan acceptable to <br /> the Board. <br /> f. Implement the Final Remediation Plan within 60 days of approval by the <br /> Executive Officer. <br /> g. Upon startup of the remediation system[s], operate the remediation system[s] <br /> continuously, except for periodic and required maintenance. Any interruptions <br /> in the operation of the remediation system[s], other than maintenance, shall be <br />
