property owner maintains that the purchase contract is no longer <br /> in effect and binding upon Seller, irrespective of whether Seller <br /> agrees with the property owner ' s position on this point. Buyer <br /> shall also have the right , at any time , to confirm with the <br /> property owner or Seller ' s escrow company whether or not there is <br /> still a valid and viable purchase contract and escrow for sale of <br /> the said Realty, or that Seller and the property owner disagree <br /> regarding this issue, then Buyer shall have the right to cancel <br /> this Instrument and to receive back its purchase deposit payment <br /> (s ) . <br /> 22. It is understood by and between Buyer and Seller that <br /> the subject site and easterly remainder will both require utility <br /> and storm drain connections . Both Buyer and Seller will <br /> cooperate for their mutual benefit to design and contract service <br /> to serve both parcels. <br /> 23 . Seller <br /> shall notify Buyer of Seller' s approval or disapproval within ten <br /> days from receipt of said plans . In the absence of such <br /> notification by Seller to Buyer within said ten day period, <br /> Buyer' s plans shall be deemed approved by Seller .
