16 . Upon acceptance of this offer, Buyer shall have the <br /> right to enter said Realty to place signs thereon and to make <br /> tests, measurements and examinations. <br /> 17 . In the event of issuance, prior to closing, of notice <br /> of a partial or total condemnation of said Realty, Buyer may <br /> cancel this agreement and receive back Buyer' s Escrow deposit . <br /> If , however, Buyer nevertheless decides to close, Buyer shall <br /> notify Seller and Seller shall execute an assignment in a form <br /> acceptable to Buyer , assigning Seller ' s rights to • all <br /> compensation on account of such condemnation. Said assignment <br /> shall be delivered to Buyer through Escrow at closing. For <br /> purposes of this Provision, "condemnation" includes rights of <br /> inverse condemnation. <br /> 18 . This document and the Exhibit(s ) hereto contain the <br /> whole agreement of parties. There are no understandings except <br /> as provided herein. Any oral promise or inducement is void. No <br /> amendment can be made except in writing executed by the parties <br /> hereto, and Escrow so notified. <br /> 19 . The covenants and disclaimers herein shall not merge <br /> but shall survive closing hereunder. <br /> 20. Buyer shall comply with the Foreign Investment In Real <br /> Property Tax Act by either: <br /> A. Withholding at closing 108 of the Provision 2 <br /> purchase price and transmitting said withheld sum <br /> in accordance with law; or <br /> B. Obtaining an affidavit from Seller that Seller is <br /> not a foreign person and obtaining Seller ' s <br /> taxpayer certificate number; or <br /> C. Obtaining proof of other exemption from said Act. <br /> 21. Seller hereby agrees to provide Buyer with a copy of <br /> its fully executed contract to purchase the said Realty at the <br /> time it initially provides Buyer with the executed originals of <br /> this Instrument. Seller shall have the right, if it desires, to <br /> mask the purchase price and other payment provisions. A copy of <br /> this fully executed purchase contract shall become a part of this <br /> Instrument and is attached hereto as Exhibit B. Seller must <br /> inform Buyer, within five days, upon learning that the purchase <br /> contract is terminated or modified in any way; or if Seller <br /> concludes, or the property owner tells Seller, that this purchase <br /> contract is not viable ; or if Seller becomes aware that the <br />
