the parties hereto that Lessor shall be responsible for , <br /> and shall pay prior to delinquency, all ad valorem real <br /> property taxes assessed against the leased premises , and <br /> all other taxes and assessments of any nature whatsoever <br /> levied by any governmental agency; provided, however, in <br /> the event Lessee is assessed any personal property taxes <br /> for equipment on the property, Lessee shall be solely <br /> responsible for any such taxes . Upon purchase of the pro- <br /> perty by Lessee, taxes shall be prorated to date of close <br /> of escrow as hereinafter provided. <br /> 8 . Use. The said leased property described herein <br /> shall be used by Lessee solely for the purpose of making <br /> feasibility studies, performing soil tests , and permitting <br /> entry by authorized government officials , lenders , and <br /> other parties involved in the future development of the <br /> leased premises . Lessee agrees that he will not occupy <br /> the said premises or use the leased property, or suffer or <br /> permit the same to be occupied for any other purpose or <br /> purposes. Lessee shall use the property in such a manner <br /> as to comply with all ordinances and laws of the County, <br /> State, and Federal authorities. <br /> Lessee will not be permitted to enter into any <br /> agreements restricting the use or granting easements over <br /> the premises without Lessor' s express written consent . <br /> Lessor shall, at Lessee ' s notice of request, join with <br /> Lessee in applications and proceedings to obtain necessary <br /> use or zoning changes, but without cost or expense to <br /> Lessor. <br /> 9. Remedies on Default. If Lessee shall fail to pay <br /> any rent as herein provided, when the same is due and <br /> payable, or if Lessee shall fail to observe, keep, or per- <br /> form any other provisions of this Lease required to be <br /> observed, kept, or performed by Lessee , Lessee shall have <br /> thirty ( 30 ) days from and after written notice of default <br /> within which to cure the same. If the default is of such <br /> a nature that it cannot be completely remedied within the <br /> said thirty-day period, this provision shall be deemed to <br /> be complied with if Lessee begins correction of the <br /> default within the said thirty-day period and thereafter <br /> proceeds , with reasonable diligence and in good faith , to <br /> effect the remedy as soon as practicable. If Lessee shall <br /> fail to cure any default, as provided herein , then Lessor <br /> may exercise any and all remedies provided by law or <br /> equity by reason of such default, including the right, at <br /> Lessor' s option, of terminating this Lease and the accom- <br /> panying Purchase Agreement.
