entitled to immediate possession of said leased property, <br /> and, at Lessor' s option, may enter into and upon said <br /> demised premises without notice to Lessee, and exclude <br /> Lessee and all persons and property therefrom, and by pro- <br /> cess of law, or otherwise, take and resume possession of <br /> the leased property. <br /> Further, any repossession of said demised premises <br /> shall not constitute a termination of this Lease unless <br /> Lessor so notifies Lessee, in writing, and Lessor shall <br /> have the right, at their option, to lease all, or any por- <br /> tion of the property herein leased or repossessed, to any <br /> other person or persons upon such terms and conditions as <br /> Lessor shall determine. <br /> 10 . Insolvency of Lessee. Lessee agrees that in the <br /> event all, or substantially all , of his assets are placed <br /> in the hands of a receiver or trustee, and in the event <br /> such receivership or trusteeship continues for a period of <br /> ten ( 10 ) days, or should Lessee make an assignment for the <br /> benefit of creditors, or be adjudicated a bankrupt, or <br /> should the Lessee institute any proceedings under any <br /> State or Federal Bankruptcy Act, wherein Lessee seeks to <br /> be adjudicated a bankrupt, or seeks to be discharged of <br /> his debts, or should any involuntary proceedings be filed <br /> against such Lessee under such bankruptcy laws, and the <br /> Lessee consents thereto, or acquiesces therein by pleading <br /> or default, then this Lease, or any interest in and to the <br /> demised premises shall not become an asset of such pro- <br /> ceedings , and in addition to any and all rights or reme- <br /> dies of Lessor hereunder, or as provided by law, it shall <br /> be lawful for Lessor, at their option, to declare the term <br /> hereof ended and to re-enter the demised premises and take <br /> possession thereof and remove all persons therefrom, and <br /> Lessee shall have no further claim hereunder. In the <br /> event this Lease is continued in accordance with Section <br /> 365 of the Bankruptcy Reform Act of 1978, then this Lease <br /> shall convert to a thirty-day, month-to-month tenancy. <br /> 11 . Assignment and Subletting. The Lessee shall not <br /> assign this Lease, nor sublet the whole or any part of the <br /> demised premises, without first obtaining the written con- <br /> sent of Lessor, and a consent to an assignment, <br /> subletting, or use by another person, firm, or entity, <br /> shall not be deemed to be a consent to any subsequent <br /> assignment, subletting, or use by another person or <br /> entity. <br /> 12 . Entry for Inspection. Lessor shall have the <br /> -4- <br />
