Linne Rd. <br /> Tracy, CA., 95736 <br /> San Joaquin County Public Health Services, Environmental Health Division (PHS- <br /> EHD), has received a request for a written clarification of the recommendations for <br /> oxygenate sampling and providing oversight for the investigation and remediation of the <br /> petroleum impacted soils from the removed farm underground tanks (UGT) at the <br /> above noted property. <br /> The farms UGTs that were located at this property are not included in the definition of <br /> an UGT contained in the California Health and Safety Code or the California Code of <br /> Regulations. Therefore, PHS-EHD does not have the regulatory authority to direct the <br /> investigation and cleanup of this property but can serve as regulatory oversight for the <br /> site assessment under a voluntary understanding with the responsible party. <br /> Responsible parties that request PHS-EHD oversight in writing will be expected to <br /> voluntarily comply with recommendations issued by PHS-EHD during the <br /> investigation/site assessment. Without voluntary compliance with PHS-EHD <br /> recommendations, this site will be referred to the Central Valley Regional Water Quality <br /> Control Board (CVRWQCB) for regulatory oversight. <br /> As of this date, your consultant, Advanced Environmental Concepts, lnc.(AEC), has <br /> indicated their desire to continue the investigation by submitting a workplan to over- <br /> excavate the soils impacted from the release of the UGTs. PHS-EHD can provide <br /> oversight and has commented on the workplan in conversations with Mr. Jonathan <br /> Buck of AEC. Investigations at contaminated groundwater UGT sites require the <br /> laboratory analyses for at least five (5) oxygenates by EPA Method 8260. PHS-EHD is <br /> following this UGT recommendation and will require that the oxygenates listed in the <br /> enclosed CVRWQCB memo be included in the farm UGT soil and groundwater <br /> investigations at 700 W.
