Page 6 of 27 <br /> Agent: Any person designated or retained by Manteca to fulfill the sampling, <br /> monitoring,reporting, or inspection services of Manteca as required by the Waste <br /> Ordinance,the industrial discharge permit.and/or all applicable State, Federal,or local <br /> regulations, and/or to perform the enforcement actions required by this Waste Ordinance. <br /> Agents may include,but are not limited to any of the following: the Manteca Director of <br /> Public Works,Assistant:Director of Public Works, Inspector,Supervisor, City Attorney, <br /> and any consultant retained by the City to perform such services. <br /> Authorized representative of industrial user: A principal executive officer of at least <br /> the level of vice president, a general partner or proprietor, a duly authorized <br /> representative of the individual designated above if such representative is responsible for <br /> the overall operation of the facilities from which the discharge originates. <br /> Bypass: The intentional diversion of wastes from any portion of a treatment facility. <br /> Categorical User:Any industrial user who,on the basis of industrial activity at the <br /> facility in question must comply with National Categorical Standards. <br /> Cease and Desist Order: An Administrative Order issued by Manteca requiring a <br /> discharger to halt discharge to the water pollution control system. <br /> Chronic Violation:A violation of significant noncompliance when sixty six percent or <br /> more of sample measurements exceed the same daily maximum limit or the same average <br /> limit over a six month period. <br /> City: Refers to the City of Manteca <br /> Compliance Order: An Administrative Order directing the discharger to achieve or <br /> restore compliance by a specified date. A Compliance Order may include a compliance <br /> schedule with specific milestones for achieving steps toward.compliance, for tracking <br /> progress, and for the discharger to report progress. <br /> Composite Sample: A sample that is collected over time, formed either by continuous <br /> sampling or by mixing discrete samples. The sample may be composited either as a time <br /> composite sample: composed of discrete sample aliquots collected in one container at <br /> constant time intervals providing representative samples irrespective of stream flow: or as <br /> flow proportional composite sample: collected either as a constant sample volume at time <br /> intervals proportional to stream flow, or collected by increasing the volume of each <br /> aliquot as the flow increases while maintaining a constant time interval between the <br /> aliquots. <br /> Cooling Water: <br /> 1. Uncontaminated: Water used for cooling purposes only which has no direct <br /> contact with any raw material, interniediate, or final products and which does <br /> Permit No. 05-3 <br /> Cardoza Enterprises <br />
