Page 21 of 27 <br /> A decision not to reconsider a final permit shall be considered final administrative action <br /> for purposes of judicial review. The permittee seeking.judicial review of the final <br /> administrative action must do so by filing a compliant with the Superior Court of <br /> California County of San Joaquin. <br /> D. Property Rights <br /> Issuance of this permit does not convey any property rights of any sort, or any exclusive <br /> privileges,nor does it authorize any injury to private property or any invasion of personal <br /> rights,nor any violation of federal, State, or local law or regulations. <br /> E. Duty to Reapply <br /> If the pennittee wishes to continue an activity regulated by this pen-nit after the expiration <br /> date of this permit,the permittee must submit an application for anew permit at least 90 <br /> days before the expiration date of this permit. <br /> F. Continuation of Expired Permits <br /> An expired pen-nit will continue to be effective and enforceable until the permit is <br /> reissued if: <br /> 1. The permittee has submitted a request to renew the permit at least ninety(90)days <br /> prior to the expiration date of the user's existing permit. <br /> 2. The failure to reissue the permit,prior to expiration of the previous permit, is not due <br /> to any act or failure to.act on the part of the permittee. <br /> PART 9—OPERATION AND MAINTENANCE OF POLLUTION CONTROLS <br /> A. Proper Operation and Maintenance <br /> The permittee shall at all times properly operate and maintain all facilities and systems of <br /> treatment and control (and related appurtenances) which.are installed or used by the <br /> permittee to achieve compliance with the conditions of this permit. Proper operation and <br /> maintenance includes but is not limited to effective performance, adequate funding, <br /> adequate operator staffing and training, and adequate laboratory and process controls, <br /> including appropriate quality assurance procedures. This provision requires the operation <br /> of back-up or auxiliary facilities or similar systems only when necessary to achieve <br /> complance with the conditions of the permit. <br /> s <br /> B. Monitoring facilities. <br /> .The permittee shall operate and maintain at their expense monitoring facilities to allow <br /> inspection, sampling and flow measurement of the waste discharge. <br /> Pennit No. 05-3 <br /> Cardoza Enterprises <br />
