ORDINANCE NO [1275 <br /> PAGE NO 20 <br /> (i) Inspection Fee The purpose of this fee is to reimburse Manteca <br /> for any inspection costs as necessary and reasonable to <br /> demonstrate compliance with this industrial ordinance and/or the <br /> industrial discharge permit, following a violation <br /> (ii) Additional Sampling Fee The purpose of this fee is to recover <br /> Manteca costs for sampling, lab fees, travel, equipment, labor and <br /> any other costs incurred by Manteca, to complete sampling and to <br /> demonstrate compliance with this Waste Ordinance and/or the <br /> industrial discharge permit <br /> (iii) Damage Fee The purpose of this fee is to recover costs incurred <br /> by Manteca for the protection from or repair of damage to the water <br /> pollution control system because of a harmful or hazardous <br /> discharge in violation of this Waste Ordinance by any person <br /> (iv) Manteca Permit Violation Fee The purpose of this fee is to recover <br /> costs assessed to Manteca as a result of a user discharge violation <br /> causing pass through or interference, such that Manteca is unable <br /> to meet the requirement of its NPDES Permit or any other permit <br /> requirements, including an increase in the magnitude or duration of <br /> a violation The fee shall include the amount of any fine(s) levied <br /> against Manteca by EPA or any other regulatory agency issuing a <br /> fine, because of a violation of Manteca's permit The Permit <br /> Violation Fee shall also include reimbursement of costs for <br /> sampling, travel, labor, and any other expenses incurred by <br /> Manteca as a result of the person's discharge causing Manteca to <br /> be in violation of its permit <br /> The fees listed and described in this section, shall be payable to Manteca only and <br /> do not include any additional fees which may be levied by any member jurisdiction <br /> providing collection services <br /> (d) Delinquent Fees All fees as described above, are due and payable <br /> within five days of the posted mailing date of the notice All fees not paid <br /> within 30 days of issuance will be considered delinquent and are subject <br /> to a subsequent delinquent charge amounting to 10% of the amount of the <br /> fee in question Failure to pay fees within 90 days of issuance shall result <br /> in enforcement action by Manteca This enforcement action may include <br /> termination of service and/or civil action to collect all outstanding fees, and <br /> delinquent charges. All costs resulting from this enforcement action will <br /> be paid by the user <br /> i _ <br />
