ORDINANCE NO 1275 <br /> PAGE NO 19 <br /> the discharge under the terms and conditions of the original permit, and to • <br /> make application to obtain new industrial discharge permit 90 days before <br /> commencing the continued discharge Permit transfer as a result of <br /> corporate or personnel reorganization, insolvency or bankruptcy shall be <br /> subject to the approval of the Assistant Director of Public Works and must <br /> be requested in writing by the user <br /> (c) Authority to Assess and Collect Fees All discharges to the Manteca <br /> water pollution control system shall be subject to the terms and conditions of <br /> this Waste Ordinance and to the terms, conditions, fees, and fines as <br /> described below and as contained in the Manteca Fee Schedule and as set <br /> forth in Section 13 020 090 of this Waste Ordinance <br /> Manteca shall have the authority to assess and collect fees, for cost recovery <br /> purposes The fees are cumulative and may include, but are not limited to, the <br /> following. <br /> (1) Permit Fee: A permit fee is due when the permit application is <br /> submitted to Manteca The purpose of this fee is to recover costs <br /> incurred by Manteca for application review, permit issuance, and <br /> administration of the permit The permit fee shall be as below, based on <br /> the classification of the discharger by the Director of Public Works or his <br /> agent The classification will be based primarily on the amount of Manteca <br /> resources expected to be required for permit issuance and administration <br /> Where a permit is denied, after payment of the permit fee, a portion of the <br /> fee may be refunded to the discharger, at the discretion of the Director of <br /> Public Works <br /> (2) Inspection Fee The purpose of this fee is to recover Manteca costs <br /> for review and/or inspection of a user's pretreatment system design, <br /> drawings, construction and/or operations, chemical or hazardous materials <br /> storage and/or sampling facilities, and procedures used by the user, as <br /> applicable and as deemed necessary and reasonable by the Assistant <br /> Director of Public Works, to demonstrate compliance with this Waste <br /> Ordinance or any directive of the Director of Public Works or Manteca <br /> This fee is due when the service is rendered <br /> (3) Sampling Fee The purpose of this fee is to recover Manteca costs for <br /> sampling, lab fees, travel, equipment, labor or any other costs accrued by <br /> Manteca to complete sampling as required by this Waste Ordinance, the <br /> industrial discharge permit, or under directive of the Director of Public <br /> Works to demonstrate compliance This fee is due when the service is <br /> rendered <br /> (4) Noncompliance Fees: These are fees resulting from violations of this <br /> Waste Ordinance or the industrial discharge permit, There is no upper - <br /> limit for noncompliance fees which may include any or all of the following, <br /> dependent upon the severity of the violation or violations <br />
