i f <br /> ORDINANCE NO 1,27 <br /> PAGE NO 10 <br /> not comply with the requirements of this Waste Ordinance or the industrial <br /> discharge permit <br /> (4) Manteca and its agent, shall have the authority to obtain copies of any <br /> monitoring and sampling records as necessary to establish compliance or <br /> non-compliance with the objectives of this Ordinance or the industrial <br /> discharge permit, and if necessary, remove those records from the <br /> premises for copying purposes These records include, but are not limited <br /> to, record keeping required under 40 CFR 403 12 of the Act <br /> (5) Manteca and its agent shall have the authonty to require an industrial <br /> waste discharger to install and operate pretreatment facilities as deemed <br /> reasonable and necessary by the Assistant Director of Public Works to <br /> meet the EPA categorical pretreatment standards and the local limits <br /> described in this Waste Ordinance <br /> (6) Manteca and its agent shall have the authority to specify a compliance <br /> schedule for the user to install pretreatment, monitoring, and sampling <br /> equipment, and shall have the authority to require compliance reports on <br /> meeting scheduled milestones <br /> (7) Manteca and its agent shall have the authority to inspect the <br /> installation and operation of the pretreatment facilities <br /> (8) Manteca and its agent shall have the authority to issue an <br /> Administrative Order, including a Show Cause Order, Cease and Desist <br /> Order, and Compliance Order to any person discharging to the water <br /> pollution control system. <br /> (9) Manteca and its agent shall have the authority to seek injunctive relief <br /> and pursue civil and criminal penalties for violations of this Waste <br /> Ordinance as may be provided for under the Act and State and Federal <br /> laws <br /> (10) Manteca and its agent shall have the authority to levy fees for <br /> additional services or to recover damage costs, which are a result of a <br /> discharge, as described in Section 13 020 050 (c) of this Waste <br /> Ordinance <br /> (11) Manteca and its agent shall have the authority to halt or <br /> suspend a discharge in the event of an actual or threatened discharge <br /> which is in violation of this Waste Ordinance, the industrial discharge <br /> permit, or the regulatory conditions of 40 CFR 403 8(f)(1)(vi)(B), or in the <br /> event of an emergency, or a condition in which the safety of humans or <br /> the environment is threatened <br /> • <br /> (b) Authorities of the Director and/or Assistant Director of Public Works <br />
