ORDINAN43E NO 1275 <br /> PAGE NO 5 <br /> • Enforcement Response Plan - Guidelines for Manteca's enforcement of <br /> Federal, State, and local laws related to waste discharge to the POTW, either <br /> directly or indirectly, and to waters of the State and/or United States, and <br /> enforcement of the Manteca Waste Ordinance No 13 20, <br /> • Manteca Waste Ordinance No. 13.20 - Which describes the authorities of <br /> the City of Manteca to enforce E P A and local requirements related to waste <br /> discharge to the Manteca water pollution control system <br /> • Manteca Industrial Discharge Permit - A permit stating the conditions, <br /> prohibitions, limits, and requirements for discharges to the Manteca water <br /> pollution control system that is issued to all significant industrial users and <br /> any other users that discharge to the water pollution control system a waste, <br /> of substantial volume or of a concentration, that the Director of Public Works <br /> deems significant and therefore requires a permit. <br /> Member Jurisdiction: Any city or agency, such as the City of Lathrop, which <br /> owns and operates a collection system connected to the City of Manteca water <br /> pollution control system The relation of a member jurisdiction is specified in a <br /> jurisdictional agreement <br /> National Pretreatment Standards: Any regulations containing pollutant <br /> discharge limits promulgated by EPA in accordance with Section 307 (b) and (c) <br /> of the Act (33 U S C 1317) and which apply to a specific category of industrial <br /> users These regulations are found at 40 CFR Chapter 1, Subchapter N, Parks <br /> 405-471 This term includes prohibitive discharge limits established pursuant to <br /> [40 CFR] § 403 5 <br /> New Source: Any building, structure, facility, or installation from which there is or <br /> may be a discharge of pollutants, the construction of which commences after the <br /> publication of proposed Pretreatment Standards under section 307(c) of the Act <br /> which will be applicable to such source if such standards are thereafter <br /> promulgated in accordance with that section, provided that <br /> a) The building, structure, facility, or installation is constructed at a site which no <br /> other source is located, or <br /> b) The building, structure, facility, or installation totally replaces the process or <br /> production equipment that causes the discharge of pollutants at an existing <br /> source, or <br /> c) The production or wastewater generating processes of the building, structure, <br /> facility, or installation is substantially independent of an existing source at the <br /> same site In determining whether these are substantially independent, • <br /> factors such as the-extent to which-the-new facility is integrated with the- - - <br /> existing plant, and the extent to which the new facility is engaged in the same <br /> general type of activity as the existing source, should be considered <br />
