ORDINANCE NO '1275 <br /> PAGE NO 35 <br /> (d) Disclosure of Information All users are responsible for notifying • <br /> Manteca of known violations of this Waste Ordinance and/or the industrial discharge <br /> permit when they occur In the event of a spill, accidental discharge, bypass of the <br /> pretreatment system, or the imminent danger of same, which may endanger the <br /> health or safety of Manteca staff, the public, or the environment is present, the user <br /> must immediately notify the Manteca Director of Public Works or his agent by a <br /> phone call or in person Dischargers must also notify Manteca of any changes to <br /> their operations which may change the quantity or quality of their discharge, prior to <br /> the change Failure to notify Manteca of a violation, spill, bypass or accidental <br /> discharge is a violation of this Waste Ordinance <br /> 13.020.100 — Hearings and Appeals <br /> (a) Any user, permit applicant, or permittee, found in violation of this <br /> Waste Ordinance or the industrial discharge permit, or adversely affected by a <br /> decision, action, or determination of the Director of Public Works, his agent, or <br /> Manteca interpreting or implementing this Waste Ordinance or in any permit <br /> enforcement action issued herein, may file a written request for reconsideration of <br /> the decision, action, or determination within 10 working days of notification of said <br /> decision, action, or determination The written request for reconsideration shall <br /> detail facts supporting the user's request and such facts must include a statement <br /> listing all relevant facts which must be considered, including such facts that may not <br /> have been known or available to Manteca at the date <br /> of such decision, action, or determination <br /> (b) The Assistant Director of Public Works shall render decision in writing <br /> on the request for reconsideration within 10 working days of receiving such request, <br /> If the decision on the request for reconsideration still is unacceptable to the user, the <br /> user may file a request for appeal to the Director of Public Works, within 10 working <br /> days of notice of the Assistant Director's decision When a written request for appeal <br /> has been received and logged with the Director of Public Works, the Director shall <br /> schedule a hearing within 45 days from receipt of the request for appeal and the <br /> Director of Public Works shall make a final ruling on the Assistant Director's decision <br /> within 90 days from receiving the request for appeal <br /> (c) Except where deemed appropriate by the Director of Public Works, this <br /> reconsideration and appeal process described in this section of this Waste <br /> Ordinance shall not halt or delay any enforcement action taken by Manteca <br /> (d) Manteca reserves the authority to designate a hearing officer to hear <br /> all testimony presented for a hearing or appeal <br /> 13.020,110 — Severability <br /> (a) If any provision, paragraph, word, section,_or_article of this Waste Ordinance in •_ __ <br /> invalidated by any court of competent jurisdiction, the remaining provision, <br />
