5 <br /> ORDINANCE NO 1275 <br /> PAGE NO 34 <br /> including costs for repair, administrative costs, and a penalty of <br /> $25,000 per day for each violation pursuant to California <br /> Government Code 54740 <br /> (b) Costs for Enforcement Actions All costs accrued by Manteca to <br /> undertake enforcement actions shall be paid by the user in violation These costs <br /> include, but are not limited to, all fees described in Section 13 020 090 (a) (2) of this <br /> Waste Ordinance, attorney's fees, and fees associated with termination of service <br /> All such fees are payable to Manteca and are in addition to any costs accrued by <br /> member jurisdictions All such fees are due and payable upon receipt of notice <br /> Delinquent flees will result in delinquent charges and/or enforcement actions, as <br /> described in Section 13 020 050 (d) of this Waste Ordinance <br /> (c) Emergency Powers The Director of Public Works or his agent shall <br /> have full power and authority to take any necessary precautions and measures to <br /> protect the water pollution control system, POTW personnel, public, and the <br /> environment from endangerment or threat of endangerment, or any condition that is <br /> likely to result in a discharge which presents an imminent hazard to the public <br /> health, safety, or welfare, or which, either singly or by interaction with other <br /> discharges, is an imminent hazard to the water pollution control system, places <br /> Manteca in violation of its NPDES permit or any other California State or Federal law <br /> or permits The available precautionary measures include suspension of wastewater <br /> treatment and collection services and/or an industrial discharge permit, issuance of a <br /> Cease and Desist Order, and/or any of the following decontamination, sewer <br /> closure, packaging, diking, and transportation of materials, in order to protect life or <br /> property, or to prevent further damage to the environment of the water pollution <br /> control system In pursuit of such precautionary measures, Manteca personnel or <br /> any agent of the City of Manteca shall have immediate access to the premises In <br /> addition, the Director of Public Works or his agent shall have the authority to prohibit <br /> approach to the scene of such an emergency any vehicle, vessel, or thing, and all <br /> persons not specifically employed in the correction of the emergency condition or the <br /> preservation of life or property in the vicinity thereof <br /> Any user receiving Cease and Desist Order or requested to suspend discharge to <br /> the water pollution control system from or by Manteca shall immediately cease or <br /> suspend the discharge or contribution to the water pollution control system In the <br /> event a user fails to voluntarily comply with the requirements of the Cease and <br /> Desist Order or suspension of service, the Director of Public Works shall take such <br /> steps as deemed necessary to halt the discharge or contribution, including <br /> severance of the user's connection to the water pollution control system, to prevent <br /> or minimize damage to the POTW or endangerment to the public, the POTW, or the <br /> environment <br /> In addition to any enforcement actions issued to the user, the user shall submit a <br /> detailed written report of the emergency condition to the Director of Public Works <br /> • within 15 days of the occurrence. The detailed report shall describe the cause(s) of <br /> the emergency event or harmful contribution and the measures which have been <br /> taken to prevent any future or repeated occurrence <br />
