. f <br /> ORDINANCE NO 1275 <br /> PAGE NO 32 <br /> . pollution control system, Manteca, or the environment as a <br /> result of a discharge violation <br /> (iii) Permit Violation Fee The Assistant Director of Public Works <br /> may assess a permit violation fee to recover costs for fines <br /> assessed to Manteca as a result of a violation of its NPDES <br /> permit or any other Federal, California State, or local permit <br /> The Assistant Director of Public Works also may include <br /> reimbursement of costs accrued by Manteca for additional <br /> sampling, inspection, environmental clean up, lab fees, and any <br /> other costs incurred by Manteca as a result of the permit <br /> violation These costs may be included as part of the Permit <br /> Violation Fee and Damage Fee which may be assessed to the <br /> user, if the discharge violation caused, singly or in combination <br /> with other discharges, Manteca to violate its permit This <br /> includes an increase in the order of magnitude of the Manteca <br /> permit violation <br /> (3) Suspend Service <br /> Manteca has the authority to suspend service to any user found in <br /> violation of the Waste Ordinance, the industrial discharge permit, <br /> • California State and/or Federal regulations, or the local limits <br /> The Director of Public Works or his agent may also suspend service in <br /> instances when a user refuses Manteca staff entry to the user's <br /> premises for inspection, monitoring, or sampling purposes or to abate a <br /> perceived illegal discharge The suspension of service may remain in <br /> force until the user allows entry to the premises <br /> (4) Administrative Order <br /> Manteca has the authority to issue an Administrative Order to bring a <br /> user into compliance An Administrative Order maybe either a cease <br /> and desist order, show cause order, or compliance order The filing of <br /> an Administrative Order is under the discretion of the Director and/or <br /> Assistant Director of Public Works and is considered to be an <br /> intermediate step to enforcing compliance <br /> (5) Annual Publication of SNC Dischargers <br /> In order to comply with Federal Pretreatment Regulations, 40 CFR <br /> 403 8 (f) (2) (vii), and to encourage users to remain in compliance, <br /> Manteca shall annually publish a list of all users which were in <br /> significant noncompliance (SNC) at any time in the past twelve months <br /> • This public notification shall be in the largest daily newspaper published <br /> in the service area <br />
