ORDINANCE NO 1274 <br /> PAGE NO 33 <br /> (6) Other Noncompliance Penalties . <br /> The following enforcement measures will be used in instances of <br /> serious noncompliance, usually resulting in extreme damage to the <br /> water pollution control system, or from fraudulent practices, criminal <br /> noncompliance, violation of an Administrative Order, violation of a <br /> compliance schedule, or negligent or intentional discharge of waste <br /> which causes a threat to the health and/or safety of the public, Manteca <br /> personnel, or the environment <br /> (i) Terminate Service Waste discharge service to the water <br /> pollution control system may be terminated, by disconnection of <br /> a user's sewer connection, upon written notice by the Director of <br /> Public Works or his agent for any of the following reasons <br /> • Violation of an Administrative Order <br /> • Refusal to cooperate with Manteca staff or comply with Manteca <br /> policies <br /> • Refusal to allow Manteca staff reasonable access to a premise <br /> for purposes of inspection, monitoring, or abating an illegal <br /> discharge <br /> • Fraudulent actions relating to reporting, self-monitoring, of <br /> Manteca sampling or inspection <br /> • One or more serious violations which endanger the health and/or <br /> safety of the public or Manteca personnel or which endangers <br /> the water pollution control system and/or the environment. <br /> (u) Pursuit of Criminal Prosecution Where Manteca or its Director <br /> of Public Works determines that a criminal violation of the <br /> Waste Ordinance has occurred, Manteca may pursue criminal <br /> prosecution, pursuant to provisions of the Federal Clean Water <br /> Act and California Government Code Sections 54725 and <br /> 54739 For each violation the offender may receive 30 days in <br /> jail or a fine of$1,000, or both A violation may be recorded for <br /> each instance of non-compliance and for each day the <br /> noncompliance occurred <br /> (iii) Pursuit of Civil Action. Where deemed appropriate by the <br /> Director of Public Works and the City Attorney, Manteca will <br /> pursue civil action Actions taken may include, but are not <br /> limited to civil suits for damage to the water pollution control - <br /> system, injunctive relief, and/or civil penalties Civil actions may <br /> be pursued on a strict liability basis, regardless of intent, and <br /> shall include reimbursement for all costs incurred by Manteca, <br />
