r y_
Letter to Mr.Parada and Ms. Dc ,ass, S WRCB
January 11, 1999
Page 2
Enclosed is Site Check Report for San Joaquin County listing Local Oversight Charges indicating this
pending amount, which we are submitting to satisfy;;the request and receive reimbursement eligibility..
County Site Work Requests
Additionally, the County is requiring the Marci's to install additional monitoring wells, and conduct
additional sampling and analytical. This is evidenced by the enclosed letter from.County dated August 31,
1998, submitted workplan from Wm. J. Hunter & Associates dated December 1998, and response from
County dated December 10, 1998. The Marci's are concerned as to how this additional work will be
reimbursed. In addition, the Marci's have limited financial resources to continue with further site work
and investigation. Furthermore, Mr. Hunter has stated in paragraph four of his letter dated October 29,
1998,to the County that"We strongly disagree with your departments refusal to close this very `low risk'
site. We question""tlie need`for spending additional funds to define the limits`of a minor amount_of
contamination when there is no existing technology fore cleaning it up."
a i
Request for Assistance
We kindly request that you contact Ms. Margaret Lagorio, Supervising REHS for the County, with regard
to the additional work requests and associated costs for this work. As ourclients have not been fully
reimbursed from the Cleanup Fund for prionwork done on the site, and until that issue is resolved, they
lack the funds to proceed with further work. ,We hope that those funds will be released and available by
the time that we have received approval from the Fund for this next stage of investigation.
We have discussed with Mr. Parada that upon sufficient additional expenditures, the Marci's would
submit a reimbursement package that would be reviewed and reimbursed in''accordance with the Fund's
practices and procedures and that their eligibility for Fund reimbursement would remain. .
The Marci's would like to thank you in advance for your consideration and:assistance. ;If you have any
questions, please do not hesitate to contact my office. Thank you.
Very truly yours,
GARRISON LAW CORPORATION
Mara L. Solomon,
Compliance Administrator
cc: John and Margaret Marci
Magaret Lagorio
Jennifer White
Mike Mosbacher
William Hunter&Associates
