This <br /> proposed work would be just one phase of the total site assessment activities that are required at <br /> this site, as outlined to you in SJC/EHD correspondence dated March 8, 2001. The work plan also <br /> proposes to complete a well receptor survey. <br /> As presented, the work plan would be conditionally approved by SJC/EHD,with the conditions <br /> being as follows: <br /> 1.The wells proposed for location on off-site properties are moved to areas of public right-of-way <br /> (i.e.: sidewalks). <br /> 2.The well proposed for location in the middle of Main Street is moved back onto the subject <br /> property and converted to an extraction well, or used as a boring for vertical assessment of the <br /> depth of the contamination in both soil and groundwater, or both. <br /> It is important for you to understand that the work proposed is only one phase of the work that is <br /> necessary, and required,to be completed at this site. <br /> SJC/EHD has been issuing directives to you since December 5,2000 to submit an appropriate <br /> work plan to complete the investigation at this site. On March 14,2002 a meeting was held at the <br /> SJC/EHD office to discuss your failure to comply with regulatory directives. SJC/EHD expects a <br /> final copy of the work plan to be submitted to this office with 14 days of the date of this letter. If it is <br /> not submitted, the site will be referred to the Regional Water Quality Control Board, Central Valley <br /> Region, or the San Joaquin County District Attorneys Office,for enforcement action.
