currently unavailable to evaluate whether methyl tertiary butyl ether(MTBE) was present in groundwater <br /> prior to tank replacement". PHS/EHD has contacted Alan Kemp, laboratory director of Sequoia Analytical <br /> Laboratories as recent as June 30, 1997 and has made inquiry regarding the availability of the September <br /> 1995 chromatograms. PHS/EHD has received verbal confirmation from Mr. Kemp that laboratory <br /> groundwater data, and analyst reports are in fact available. PHS/EHD recognizes the client confidentiality <br /> and contractual obligations present and understands that Mr. Kemp must discuss this data release request <br /> with Unocal representatives prior to providing PHS/EHD with data from Sequoia Analytical. Mr. Kemp <br /> has suggested that data may be available from backup tapes no later than July 7, 1997. All groundwater <br /> data from 1995 investigations shall be evaluated for the presence of MTBE. In the event MTBE is not <br /> present or quantified in all five known previous (1995) groundwater samples, PHS/EHD will consider the <br /> detection of MTBE since 1995 to be a new release of fuel hydrocarbons and an unauthorized release report <br /> will be filed for the above referenced site. As indicated in correspondence from PHS/EHD dated March <br /> 24, 1997 and inspection report from PHS/EHD dated March 7, 1997 any known or suspected ongoing <br /> release will require immediate abatement. <br /> In accordance with Title 23, Division 3, Chapter 16, California Code of Regulations and Chapter 6.7, <br /> Health and Safety Code, and specifically in order to eliminate further potential ground water degradation <br /> the responsible party shall immediately investigate and abate any and all potential, suspected or known <br /> discharges of hazardous substances including petroleum hydrocarbons to the environment at the site <br /> referenced above. The responsible party shall also immediately submit in written format a work plan <br /> which when implemented will fully define the vertical and lateral extent of soil and groundwater <br /> contaminant distribution. As a result of the current and relative absence of Benzene, Toluene, Ethyl- <br /> Benzene, and Xylenes in ground water at this site, the work plan shall continue to focus on the distribution <br /> and migration of MTBE and any other oxygenates or supplements known or suspected by the responsible <br /> party to exist in fuel mixtures received,stored,or dispensed at this site. The responsible parry at the above <br /> referenced site shall perform all site specific field work under the direct supervision and approval of <br /> PHS/EHD including the investigation and evaluation of UST system appurtenances. The responsible parry <br /> shall in advance obtain all necessary permits prior to performing any work at this site. <br /> PHS/EHD directs you as responsible party to comply with the above abatement directives and <br /> submittal of a written work plan for review no later than July 15, 1997. Failure to comply with this <br /> directive may result in enforcement action. <br /> PHS/EHD has scheduled an Adminstrative Office Hearing for July 10, 1997 at 10:30 AM to discuss <br /> enforcement actions at another Unocal Site in San Joaquin County.
