D. In accordance with the State of California Labor Code, <br /> this project may be subject to submittal of weekly <br /> payroll • records. Employers shall maintain weekly <br /> certified payrolls and upon requests by the City shall <br /> furnish copies to the Department of Public Works Contract <br /> Compliance Officer. Employers further agree to maintain <br /> payroll records for three years after the accepted <br /> completion date of the project. <br /> E. Pursuant to Section 1777.5 of the State Labor Code, the <br /> contractor must pay apprenticeship training fees, if <br /> applicable, on any worker employed in an apprenticeable <br /> craft. Fees are paid directly to the respective joint <br /> apprenticeship training committee (JAC) trust fund. If <br /> not accepted by the JAC, fees are paid to the California <br /> Apprenticeship Council, P.O. Box 603 , San Francisco, <br /> California, 94101. A certificate to employ and train <br /> apprentices must also be requested from the respective <br /> JAC prior to the start of the project. <br /> F . Employers having no fringe benefit plan or program shall <br /> insure that employees working on the project shall' <br /> receive in cash, no less than the amounts specified for <br /> fringe benefit payments in the prevailing wage <br /> determination. <br /> G. To insure compliance with prevailing wage rate <br /> requirements, the City shall review ten per cent (10%) of <br /> all public works construction projects for the calendar <br /> year. Contractors upon request shall furnish certified <br /> payroll records and review any additional reports <br /> necessary for a comprehensive review. <br /> 5. Equal employment opportunity (EEO) : The contractor will adopt <br /> the following EEO policy statement: <br /> "It is a policy of this company not to discriminate <br /> against any employee or applicant for employment because <br /> of race, color, religion, sex, or national origin. <br /> Affirmative action shall be taken to insure that <br /> applicants are treated without regard to race, color, <br /> religion, sex or national origin. Such action shall <br /> include, but is not limited to, employment; upgrading, <br /> demotion or transfer; recruitment or advertising; lay-off <br /> or termination; rates of pay or other forms of <br /> compensation and selection for training, including <br /> apprenticeship, pre-apprenticeship, and/or on-the-job <br /> training. " <br /> 6. Any violation of the provisions specified herein shall be <br /> considered a breach of contract and shall lead to the <br /> enforcement of penalties and forfeitures. <br /> 7. It is understood that the contractor in performing the <br /> services hereunder, operates as an independent contractor and <br /> that contractor, its employees, or agents are not employees <br /> and,/or agents of the Cl.ty. <br />
