850 Milgeo Road, Ripon '
Page 2
contamination emanating from Mr. Shockey's property. EHD has been
provided a copy of a document, signed by Randy Eskes that states MGR LLC
refuses to give permission to AGE to install a monitoring well on the MGR LLC
property. EHD requests that you grant access for the installation of the required
groundwater monitoring well. The AGE letter did not explain that installation of
a monitoring well on the MGR LLC property is necessary so that water samples
can be collected repeatedly over time so the contaminant plume can be
evaluated continuously whereas a soil boring with a one time water sample only
provides information at that time.
Please be advised that the definition of a responsible party, in the California
Code of Regulations, Underground Storage Tank Regulations, includes any
owner of property where an unauthorized release of a hazardous substance
from an underground storage tank has occurred. If MGR LLC chooses to deny
Mr. Shockey access to investigate the contamination that has migrated from his
property to the'MGR LLC property by installation of a monitoring well, then
MGR LLC can be named as a responsible party and be required to investigate
the contamination on the property they own that has APN 261-080-23. It is in
the best interest of MGR LLC to cooperate with Mr. Shockey in the investigation
of the groundwater contaminant plume originating from his site and migrating to
the MGR LLC property that has APN 261-080-23.
If you have any questions contact Harlin Knoll, Senior REHS, at (209) 468-
3442.
Donna Heran, REHS, Director
Environmental Health Department
Harlin Knoll, Senior REHS Margam-L Lagodo, REFIS
LOP/Site Mitigation Unit 1V Program Coordinator Unit IV
xa Cc: James Barton, CVRWQCB
1 Lee Shockey
f Art Deicke, AGE
