EHD has been <br /> provided a copy of a document, signed by Randy Eskes that states MGR LLC <br /> refuses to give permission to AGE to install a monitoring well on the MGR LLC <br /> property. EHD requests that you grant access for the installation of the required <br /> groundwater monitoring well. The AGE letter did not explain that installation of <br /> a monitoring well on the MGR LLC property is necessary so that water samples <br /> can be collected repeatedly over time so the contaminant plume can be <br /> evaluated continuously whereas a soil boring with a one time water sample only <br /> provides information at that time. <br /> Please be advised that the definition of a responsible party, in the California <br /> Code of Regulations, Underground Storage Tank Regulations, includes any <br /> owner of property where an unauthorized release of a hazardous substance <br /> from an underground storage tank has occurred. If MGR LLC chooses to deny <br /> Mr. Shockey access to investigate the contamination that has migrated from his <br /> property to the'MGR LLC property by installation of a monitoring well, then <br /> MGR LLC can be named as a responsible party and be required to investigate <br /> the contamination on the property they own that has APN 261-080-23.
