MTBE contamination has been present in the <br /> groundwater underlying this site since November, 1997. During the construction of <br /> monitoring wells 1-4 (MW-1 - MW-4) in 1995, soil samples were collected but MTBE <br /> analysis was not required. In October, 1997 MW-5, MW-6 and MW-7 were constructed <br /> and soil samples were collected. These soil samples were analyzed for the presence of <br /> MTBE. The results were ND. On November 2"d and 3`d, 1999 WHF, Inc. installed an <br /> additional monitoring well, MW-8 up-gradient of the source release area and completed <br /> additional soil borings in the vicinity of the release area. The laboratory analysis of the <br /> soil samples collected from the well installation/boring event were "ND" for MTBE. <br /> The underground storage tanks (UST's) present on the subject property were removed in <br /> 1986 and 1988. Since the removal of the UST's, no others have been present on the <br /> 1 subject site. The use and distribution of the gasoline oxygenate, MTBE, began in early <br /> 1991 in California, three years after the removal of the UST's on-site. A conversation <br /> with a representative from Chevron indicated that MTBE was not present in their motor <br /> ' fuels until 1992. California EPA was also contacted in order to determine the year in <br /> which MTBE was first distributed in gasoline in California. This inquiry indicated that <br /> the first appearance of motor fuels containing MTBE in California was in 1991. <br /> ' Therefore, MTBE was never present in the motor fuel stored on-site. <br /> Given the evidence presented above and in the "Report of Findings—December, 1999" it <br /> ' is apparent that the MTBE contamination is from an off-site source. WHF does not <br /> believe that Eckert Cold Storage Company is responsible for any MTBE contamination <br /> on-site given the previously stated evidence summarized below: <br /> 1 <br />
