Attorney-Client Privileged <br /> The primary objective of this SAP work plan is to conduct a limited and focused scope <br /> for conducting reconnaissance of soil and ground water in the areas where RECs were <br /> identified in the Phase I ESA that may affect the planned development for RTD's <br /> upcoming RTC at the Sardee facility in accordance with the agreement between RTD <br /> and the Sardee as a part of RTD's eminent domain proceedings against Sardee. <br /> 2. SITE HISTORY SUMMARY/PHASE I ESAs AND SITE ASSESSMENT <br /> RESULTS <br /> As indicated above, TRE conducted five Phase I ESAs in accordance with the American <br /> Society for Testing and Materials (ASTM) guidelines: Standards on Environmental Site <br /> Assessments for Commercial Real Estate (E1527-00) and the All Appropriate Inquiries <br /> regulations (AAI) as contained in 40 CFR, §312.1 through 31 (both of these guidelines <br /> and requirements have now been combined and published in ASTM E1527-05) with <br /> noted exceptions and limitations contained in the Phase I ESA reports. The AAI rule, <br /> which has been recently mandated by the EPA became effective on November 1, 2006, <br /> hence the Phase I ESA report has been prepared to conform to the AAI and ASTM <br /> E1527-00. In addition several soil samples (as no ground water was encountered in <br /> these in the initial site assessment) were taken from the foregoing land parcels and <br /> analyzed for the contaminants of concerns (CDCs) (please see Figure 2). <br /> 3.
