There has been an environmental proceeding involving the County <br /> and the State regarding an underground diesel storage tank relating to the operation of the <br /> Property by the previous owner and/or lessee (the "Existing Environmental Condition"). <br /> 3.4. Seller has possession of a Phase I environmental assessment of the <br /> Property and Seiler has engaged in activity to remediate the Existing Environmental <br /> Condition, which, as of the date of the Effective Date, has not been completed or signed <br /> off by the County or the State.
