litigation activities brought by the City shall be <br /> retained and preserved by the permittee until all <br /> enforcement activities have concluded and all <br /> periods of limitations with respects to any and all <br /> appeals have expired. <br /> 23. Non-Transferability: <br /> a. Wastewater Discharge Permits shall not be <br /> reassigned, transferred to or sold to a new owner, <br /> new user, different premises, or a new or changed <br /> operation without City approval. <br /> b. In the event of any change in control or ownership <br /> of the land or wastewater discharge facility <br /> presently owned or controlled by the discharger to <br /> whom the Permit was issued, the permittee shall <br /> notify the succeeding owner or operator by a letter <br /> sent certified mail of the requirement to obtain a <br /> new Wastewater Discharge Permit. A copy of the <br /> letter must also be immediately forwarded to the <br /> City. <br /> Any new or succeeding owner shall also comply with <br /> the terms and conditions of the existing permit <br /> until a new •permit can be issued. <br /> 24 . Duration: <br /> a. Permits shall be issued for a specified time period, <br /> not to exceed 5 years. A permit may be issued for a <br /> period less than 5 years or may be stated to expire <br /> on a specific date. <br /> b. If the permittee wishes to continue an activity <br /> regulated by this permit, the permittee must submit <br /> an application for a new permit at least 60 days <br /> before the expiration date of this permit. <br /> C. An expired permit will continue to be effective and <br /> enforceable as long as one of the following <br /> conditions apply: <br /> 1. The permittee has submitted a completed permit <br /> application at least 60 days prior to the <br /> expiration date of the existing permit. <br /> 2 . The failure to reissue the permit, prior to the <br /> expiration of the previous permit, is not due <br /> to any act on the part of the permittee. <br /> 25. Permittee shall, if necessary, provide, maintain, and <br /> operate a pretreatment system capable of meeting all <br /> applicable limitations. Permittee shall insure that all <br /> Pretreatment equipment is in proper working condition at <br />
