Madison, Stockton Program: HW <br /> SUMMARY OF VIOLATIONS <br /> CLASS I CLASS II,or MINOR-Notice to Comply) <br /> 407. Four 55 gallon steel drums which previously held used oil were observed in the yard without <br /> labeling. Per Mr. Pena, these drums have been empty for more than a year. Containers larger than five <br /> gallons that previously held a hazardous material shall be marked with the date they were emptied and <br /> managed within one year of being emptied. Immediately manage all empty containers per this section. <br /> 605. A metal trough of oily liquid, holding two empty used oil drums, was observed in the yard without <br /> labeling. All hazardous waste containers shall be marked with the following information: <br /> 1. the words "Hazardous Waste" 4. physical state (liquid, solid) <br /> 2. name and address of generator 5. composition (contents) <br /> 3. hazardous properties (flammable, corrosive, reactive, toxic) 6. accumulation start date <br /> Ensure that all containers are marked with all the required information. Since it cannot be determined <br /> how long the oily liquid has been on site, immediately contact a licensed hazardous waste hauler to <br /> dispose of this waste under manifest and submit a copy of the manifest to the EHD by May 10, 2013. <br /> 701. Two solvent parts washers were observed at the facility, one in the yard and one in the shop. <br /> According to Mr. Pena, these parts washers are no longer being used since he stopped generating <br /> hazardous wastes. Facilities who generate less than 1000 kg of hazardous waste per month and do not <br /> exceed 6000 kg of waste stored on site at any time may store waste on site up to 180 days. <br /> Immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and <br /> submit a copy of the manifest to the EHD by May 10, 2013. <br /> Complete and submit a copy of the Return to Compliance Certification to the EHD by May 10, 2013 <br /> along with a statement documenting the corrective actions that have been or will be taken for each <br /> violation and any supporting paperwork. <br /> In order to inactivate the hazardous waste permit for this facility, all hazardous wastes must be removed <br /> from the facility and disposed of under manifest by a licensed hazardous waste hauler. Provide copy of <br /> manifests to the EHD by May 10, 2013. The wastes observed on site include: <br /> - (2) full solvent parts washers - Oily solids, including stained soil and wood pallet <br /> - (4) empty drums - Any absorbents used to clean up after removal of oily liquids <br /> -A container of oily liquid <br /> Provided: <br /> - Small Business Household Hazardous Waste Facility brochure <br /> - Return to Compliance Certification form <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY DY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE. <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD Inspector.
