The following <br /> provides DHS with a written record of our response. <br /> As you know, we have recently become aware that the County of San Joaquin has entered <br /> into condemnation proceedings for Foothill Landfill and claims ownership rights to the <br /> landfill. This claim is being contested by Waste Management Inc. As a result we are still <br /> planning to send the treated soil to Foothill and we are seeking to confirm approval for <br /> disposal by the operator and RWQCB. Given the possibility that we may not be able to <br /> dispose of the treated soil at this site,we are currently negotiating with Forward landfill and <br /> also investigating other alternatives (Altamont and Durham Road). We will notify you as <br /> soon as we can confirm the disposal site. <br /> At this time it is difficult to estimate a cut-off time for defaulting to Class I disposal for the <br /> soil. I expect that we will have a tentative agreement with a Class III landfill prior to <br /> treatment and that we would allow a maximum of four weeks after treatment for disposal. <br /> With reference to your other comments: <br /> 1) Referenced sentence to be deleted. We have provide you with a soil sampling plan for <br /> your review and approval (September 14). Confirmation samples will be taken on a 7 'x10' <br /> grid,or smaller if required for our own assurance . <br /> 2) Sentence to be changed to read " Any soils identified as having metal concentrations <br /> above TTLC will be landfilled in a Class I Hazardous Waste Landfill. <br /> 3) Section A.4.2.3 should read Section A 3.2.3. <br /> 4) Agreed. <br /> Consulting Engineers,Geologists <br /> and Environmental Scientists <br /> Offices in Other Principal Cities <br />
