Box 2089 <br /> Stockton, CA 95201 <br /> PORT OF STOCKTON, FUEL TERMINAL AREA GROUND WATER INVESTIGATION, <br /> SAN JOAQUIN COUNTY <br /> Several new areas of ground water contamination at this site have <br /> been uncovered over the past several months (see attached memo) . <br /> The full extent of contamination at the site remains undefined. <br /> The technical report including the work plan you have submitted <br /> is inadequate: it does not present a proposal for determining the <br /> full horizontal and vertical extent of contamination as we <br /> requested in our letter of 16 June 1987; it does not provide a <br /> comprehensive evaluation of existing data; it does not describe <br /> the history and background: of each site adequately. <br /> Representative samples of ground water are still not available <br /> from properly constructed monitoring wells, and the site <br /> hydrogeology has not been characterized so that decisions on the <br /> steps necessary to prevent further migration of contamination can <br /> be made. See the attached memo for specific comments on the <br /> technical report and workplan. <br /> An adequate first phase for a ground water investigation of this <br /> magnitude would address all the points in our previous letter, as <br /> well as present the conceptual plan for the investigation through <br /> the cleanup phase. <br /> A recent letter concerning this investigation, written by Steven <br /> McDonald, attorney for the Port of Stockton, states that "the <br /> Port nor its tenants. . .do not admit authority or jurisdiction of <br /> the Regional Water Quality Control Board to compel production of <br /> information or further investigation." Section 13267 of the <br /> Water Code states: <br /> " (a) A regional board, in establishing or reviewing <br /> any water quality control plan or waste discharge <br /> requirements, or in connection with any action relating <br /> thereto or authorized by this division, may investigate <br /> the quality of any waters of the state within its <br /> region. <br />
