• <br /> WASTE DISCHARGE REQUIREMENTS -3- <br /> SHELL OIL COMPANY <br /> STOCKTON BULK FUEL DISTRIBUTION FACILITY <br /> SAN JOAQUIN COUNTY <br /> 11. The Board has considered antidegradation pursuant to 40 CFR 131.12 and State Water Resources <br /> Control Board (SWRCB) Resolution 68-16 and finds that the permitted discharge is consistent with <br /> those provisions. This Order provides for an increase in the volume and mass of pollutants <br /> discharged. The increase will not cause significant impacts on aquatic life or other beneficial uses. <br /> The discharge accommodates economic expansion in the area, a benefit to the people of the state. <br /> 12. The SWRCB Water Quality Control Plan for Control of Temperatures in Coastal and Interstate <br /> Waters and Enclosed Bays and Estuaries of California (the Thermal Plan) is applicable to this <br /> discharge. <br /> 13. The State Water Resources Control Board (SWRCB) adopted the California Inland Surface Waters <br /> Plan and the Enclosed Bays and Estuaries Plan (Plans) on 11 April 1991. On 19 November 1992 <br /> the SWRCB adopted amendments to the Plans. The Plans include water quality objectives and <br /> other requirements. This discharge is subject to the Plans. This Order implements the Plans. The <br /> Enclosed Bays and Estuaries Plan applies to the Sacramento-San Joaquin Delta. However, because <br /> the Delta is a freshwater environment, the numerical water quality objectives from the Inland <br /> Surface Waters Plan shall be applied there. <br /> 14. The Plan(s) allow the Board to excuse a low volume discharger from the requirement to monitor <br /> for the constituents listed in them, if the constituents in the discharge have no significant adverse <br /> impact on water quality. Although the discharge will be up to 230,000 gallons per day when the <br /> discharge is occurring, the total monthly flow will not exceed 460,000 gallons. The Board <br /> considers it a low volume discharge. The Board also finds that the discharge will have no <br /> significant adverse impact on water quality. <br /> 15. The SWRCB adopted the Water Quality Control Plan for Salinity, San Francisco Bay/San Joaquin <br /> Delta Estuary on 1 May 1991. The Plan includes water quality objectives. This Order implements <br /> the Plan. <br /> 16. Effluent limitations, and toxic and pretreatment effluent standards established pursuant to Sections <br /> 301, 302, 304, and 307 of the Clean Water Act (CWA) and amendments thereto are applicable to <br /> the discharge. <br /> 17. The action to adopt an NPDES permit is exempt from the provisions of the California <br /> Environmental Quality Act(CEQA) (Public Resources Code Section 21000, et seq.), in accordance <br /> with Section 13389 of the California Water Code. <br /> 18. The Board has notified the Discharger and interested agencies and persons of its intent to prescribe <br /> waste discharge requirements for this discharge and has provided them with an opportunity for a <br /> public hearing and an opportunity to submit their written views and recommendations. <br /> 19. The Board, in a public meeting, heard and considered all comments pertaining to the discharge. <br />
