CITY OF ESCALON <br /> 1854 Main Street l <br /> Escalon, California 95320 <br /> RIGHT OF ENTRY AGREEMENT <br /> McHenry Avenue-Escalon Bellota Road/Highway 120 <br /> ' Widerung/Realignment Project <br /> Property Owner Jon Ney <br /> ' Property Address 1101 East Yosemite Avenue <br /> San Joaquin County APN 225-100-17 <br /> Permission is hereby granted to the City of Escalon, its consultants, representatives, and/or agents, <br /> together with their personnel and equipment, to enter onto the above-referenced real property for the <br /> purposes of conducting a limited subsurface investigation to acquire adequate data and information to <br /> _ determine if the subject property is free from contaminants of concern <br /> Activities to be performed on the property include, and are generally limited to the boring of one or <br /> ' more test wells, sampling and testing of soils, sampling and testing of groundwater, and a general <br /> observation of activities conducted at the site <br /> ' IT IS UNDERSTOOD AND AGREED <br /> 1 The area of work will be left in an orderly condition upon completion of the work, and any <br /> existing improvements that may be disturbed or removed during the course of the work will be <br /> replaced in kind <br /> ' Any drilling residue, be it soils or liquid, will be contained and/or covered and removed within <br /> ten (10)working days after completion of the work These materials will be deposited in an area <br /> that will not cause disruption to the normal activities conducted at the site <br /> 2 That permission to do the work and perform the acts stated herein shall remain m full force and <br /> effect until the completion of said sampling, testing, and removal of drilling residues, and that all <br /> rights granted hereunder shall cease when said work has been completed <br /> 3 The City of Escalon agrees to hold harmless the property owner for damages for any bodily <br /> injury to any person or damage to property caused by the herem-descnbed work on the subject <br /> property <br /> ' <br /> PRJR :WC 40 CITY OFA ON <br /> ' DATE. ` IS-7(T6 TITLE City-Manager _ <br /> DATE Apnt 12- 1226 <br /> mts tllk Viserslhennclwtnlwco3121entryagr doc <br />
