1 WHEREAS, Section XI .A.4 provides that, upon agreement. of the <br /> 2 parties in this matter on the Phase I IRA Detailed Plan, the SDCDs are <br /> • 3 to present the Phase I IRA Detailed Plan to the Special Master for <br /> 4 approval in the form of an Agreed Order; <br /> 5 NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS : <br /> 6 1 . The Phase I IRA Detailed Plan which is attached to this <br /> 7 Agreed Order as Attachment A is hereb <br /> Y approved, subject to the <br /> 8 provisions of the following paragraph. <br /> 9 2 . The SDCDs may, at their option, implement the Phase I IRA <br /> 10 Detailed Plan, including the installation and testing g of the <br /> extraction, conveyance and treatment systems contained therein, <br /> 12 <br /> 13 provided that the SDCDs shall not commence operation of the treatment <br /> 14 system nor shall the SDCDS discharge treated effluent from said <br /> 15 treatment system until the earlier of: (a) written notice from LPL <br /> 16 to the SOCDs that LPL has no objection to such operation; or (b) the <br /> • <br /> 17 District Court for the Eastern District of California shall have ruled <br /> 18 that such treatment system may be so operated. <br /> 19 <br /> IT IS SO ORDERED. <br /> 20 <br /> Dated: <br /> 21 <br /> IEL H.
