Thrifty Oil Company #172 page 2 <br /> 7647 Pacific Avenue, Stockton April 5, 2010 <br /> Semi-annual sampling events shall resume during the third quarter (July, August, <br /> September) of 2010. Starting in 2011, annual sampling shall resume during the first <br /> quarter of each year and semi-annual sampling events shall continue during the first and <br /> third quarters of each year. Geotracker submittals for these events are due on Geotracker <br /> by the 15'h of the month following the quarter's end. <br /> The status and condition of the remediation system at this site are unknown to the EHD. <br /> According to your last report (First Quarter 2009 Status Report), it is estimated that more <br /> than 210,000 pounds of contaminants had been removed from the subsurface, but no <br /> rebound testing of either vapor concentrations or groundwater impact has been <br /> performed. You are hereby directed to inspect, repair the system as needed, and <br /> initiate rebound testing during April 2010. The rebound evaluation report is due on <br /> Geotracker by July 17, 2010. Regular remediation status reports are to continue quarterly <br /> thereafter, with each submittal to Geotracker due by the 15'h of the month following the <br /> quarter's end. <br /> The EHD has tried to be cooperative with you through various delays restarting the <br /> remediation system and conducting groundwater sampling events at this site. As more <br /> than a year has passed since this site has had the remedial system online or any <br /> groundwater sampling taking place, the EHD cannot permit any further delays. <br /> Failure to comply with directives issued by the EHD could jeopardize this site's eligibility to <br /> receive reimbursement from the State Water Resources Control Board (SWRCB) Clean <br /> Up Fund (CUF) and could result in the site being referred to the Central Valley Regional <br /> Water Quality Control Board (CVRWQCB) for enforcement. <br /> Questions regarding the requirements included in this letter should be directed to Michael <br /> Infurna, minfurna@sjcehd.com or by phoning (209) 468-3454. <br /> ��"—_-- <br /> Michael J.
